1/12 🧵 Settlement offers in investor State arbitration are often treated as private bargaining, not adjudication. That line becomes hard to defend once an offer is used to suspend proceedings or to argue that a binding agreement already exists.

The challenge though, as we see right now in the Saudi/Yemen War, is that every indication points to Iran’s ability to easily destroy Gulf infrastructure if need be.
And no, Mutually Assured Destruction does not apply when Iran can strike countries one at a time.
If Iran struck Qatar’s infrastructure, sure Qatar would want to respond, but what happens if they do? Then the rest of the Gulf DOES get destroyed by Iran.
This is escalation dominance.
60 years of ICSID!
#OTD in 1966, the ICSID Convention entered into force and created ICSID, a neutral, depoliticized forum for States and foreign investors to resolve their disputes.

It's official.
As the bond market "meltdown" accelerates, the average interest rate on a 30Y mortgage in the US is up to 7.45%.
That's up +150 basis points in 6 months and the highest since 2023, when inflation was at 6.4%+.
What is happening? Let us explain.

#China's gasoline and diesel inventories have fallen to their lowest levels in more than a decade as exports surge and domestic demand recovers seasonally, according to GL Consulting.
Low stock levels appear to have raised Beijing's concerns, increasing the prospect of tighter export controls in October, according to Rystad Energy. GL Consulting said it expects exports to fall in October as state refiners prioritise domestic energy security. #oott reuters.com/business/energy/…
