In December 2025, I wrote a Substack linking to a report that U.S. Congressman Donald Norcross, D-N.J., co-wrote. This report, which previously had gone largely unnoticed, laid out policy ideas for trying to grow unions. It included lists of people who attended meetings to discuss these ideas, including in New Jersey. The ideas included sectoral bargaining, which the report called "admittedly radically different." A sectoral bargaining bill was just introduced in New Jersey. I wrote about that bill on October 5 and checked before I published that the link to the Norcross report still existed. It did. I linked to it again on that day. today is October 19. The link to the Norcross report no longer works. Not to worry, friends--I anticipated that move and downloaded the whole PDF of the report just in case anybody tried to disappear it. I will publish it on my Substack. They can't make it vanish.

I thought saying this would happen was "misinformation." That's what NJ state officials claimed anyway ...
Senator Singleton is saying every single member has heard from constituents about the independent-contractor rule situation He's saying rather than putting forward a ton of carveout bills, they need to go back and look at whether what's happening with the ABC Test is a problem

Two hours of senator after senator saying, "This thing you just did to independent contractors, none of the lawyers and accountants can figure it out. Our constituents keep calling. Moms are scared. Netflix is upset." And then you all voted yes for the guy anyway.

I just got a haircut. The woman who cuts my hair, her husband is an owner-operator trucker. We listened on my phone to part of the Senate Judiciary hearing with the acting labor commissioner while she trimmed. We heard senator after senator say there's just too much confusion about this ABC Test rule and something needs to change The hairdresser told me her husband is already seeing trucking companies telling independent-contractor drivers they're done. It's just too much risk now with this rule that nobody can figure out. He's worried he'll have to sell his rig and be out of business entirely She's asking me if I'm OK as a freelance writer, because I'm one of her longtime clients. If independent contractors like me lose our incomes and can't afford to remain her clients, then she takes a financial hit too even though she's a W-2 employee Another woman in the salon came up to us and asked if I was the person she heard the other day on NJ101.5. She said she was listening and thinking about all the independent-contractor hairdressers in the state I cannot stress how much New Jersey's ABC Test rule needs to be invalidated immediately, and our Legislature must act to protect us all from this madness ever happening again

Earlier this year, I testified in Trenton that when @GovSherrillNJ’s Labor Department adopted its own interpretation of the ABC Test in a new independent-contractor rule, people affiliated with the Communist Party USA were cheering online “I told you so” seems wholly inadequate at this point Here we have the Communist Party USA writing about how “an important first step” in achieving their goals is passing the PRO Act in Washington The PRO Act is the ABC Test bill in Congress. It’s the aggressive California version of the test’s three prongs, which can now be wielded against the whole country using New Jersey’s aggressive interpretation of those prongs @GovSherrillNJ should have respected New Jerseyans’ 99% opposition to this madness during the public-comment process. Instead, she helped these extremists further weaponize the ABC Test and advance the Communist agenda The New Jersey Legislature should invalidate the Labor Department’s ABC Test rule immediately — and then move legislation to end the use of this weaponized ABC Test in our state, once and for all And after that, think really, really hard before voting to confirm acting New Jersey Labor Commissioner Kevin Jarvis, who continues to defend this insanity by claiming nothing is changing at all cpusa.org/materials/the-labo…

.@TeamsterSOB is a hypocrite He’s talking here about how we have to protect people who don’t want to work full-time because for some people, that’s the best setup for them While he’s attacking those of us who choose to be independent contractors open.spotify.com/episode/2hI…

Remember in California, after they passed an ABC Test law, how Santa Clauses couldn't work at Christmas? I hear that New Jersey's Santas are now calling the Legislature and saying the same thing's going to happen here in December Too bad, kids! independentwomen.com/2020/12…

Responses are still coming in to yesterday's Substack, and people seem stunned that this is really happening Yes, it's happening. And to make it clear exactly what's happening, I'm coining a new term: "no-vote unions" It's an easier way to understand the concept of "sectoral bargaining," which is government giving unions a way to represent all workers in an industry without most of the workers ever voting to join As this New Jersey bill would do freelancebusting.com/p/from-…

And: Kentucky doesn't use the ABC Test to determine independent-contractor status Texas doesn't use the ABC Test either Pennsylvania uses a modified ABC Test that removes the crazy Prong B, and lets you pass Prong C in reasonable ways that NJDOL now interprets differently

Three of these four Labor Caucus co-chairs wrote a strategy paper that describes what they, themselves, call "admittedly radically different" ways of changing laws to grow unions Their report talks about reclassifying all workers as unionizable employees, whether the workers want it or not, across entire industries Their report talks about requiring companies that hire independent contractors to provide contact information for local administrative agencies, workforce development boards and legal services organizations that could help the independent contractors contest their employment status—with any companies that failed to do so being liable for damages Their report describes the government granting unions collective bargaining power across entire industries or sectors, instead of giving the employees at each workplace a vote on whether they actually wish to join a union at all They are trashing @keithsonderling because he's trying to protect all the rest of us from them and their "admittedly radically different" ideas

1/3 I told you so doesn't even feel sufficient anymore New Jersey state Senator Gordon Johnson just introduced a sectoral bargaining bill, S4709 Here is my November 2024 article about why this is a seismic change in how union organizing has historically been done in the United States -- and how the unions themselves say it's not going to stop with the Uber and Lyft drivers that these early sectoral-bargaining attempts are targeting in Massachusetts, California and now, New Jersey freelancebusting.com/p/plan-…

“NJDOL has dismissed this adoption as merely the codification of already existing regulatory actions and behavior, when, in fact, it is now leaving open an overly broad interpretation of an ABC framework from nearly a century ago. In New Jersey, this is now the legal default, and a virtually impossible standard to meet...” njbia.org/njbia-expresses-de…
