Something quietly important happened in US crypto regulation yesterday.
The #SEC updated its crypto guidance around token buybacks.
The interesting part isn't simply “buybacks are okay.”
It's the distinction underneath it.
For an already functional network, announcing a token repurchase does not, by itself, necessarily represent the kind of essential managerial promise associated with an investment contract.
Read that again.
Functional network.
Crypto spent years rewarding projects for selling promises.
#Regulation is increasingly being forced to confront something much more interesting:
What happens when the network already works without needing someone to promise that they'll make it valuable?
That's the conversation I want crypto having.
Not:
“Is the founder based?”
But:
“What can the founder actually control?”
