Rare for a vacation bench hearing an urgent election matter to dictate an order with such depth of constitutional reasoning. Justice Bagchi's distinction between judicial deference and abdication was telling. The law is settled, but its articulation in this setting stood out
Replying to @barandbench
Justice Bagchi: These principles are equally vocal in stating that constitutional courts would not, while the constitutional courts would ordinarily not interfere with the election process, but their hands are not tied when appropriate interventions are necessary to ensure that free and fair elections are not polluted by unconstitutional and illegal means.

#UPDATE: Supreme Court tags Rahul Gandhi and other INDIA bloc leaders' petition challenging the Election Commission's Special Intensive Revision (SIR) process with a pending plea filed by Rakesh Kumar Singh.
Singh's petition questions alleged unilateral decision-making by CEC Gyanesh Kumar, including decisions purportedly taken without the approval of the other Election Commissioners.
The INDIA bloc leaders' plea raises concerns over the SIR process, including Forms 6 and 7 and the Election Commission's collective decision-making.
A Bench of CJI Surya Kant and Justice Joymalya Bagchi has issued notice. The matters will be heard on October 27.

#BREAKING: Supreme Court declines to entertain constitutional challenge to Section 163 BNSS, the provision replacing Section 144 CrPC that empowers authorities to impose prohibitory orders restricting public gatherings and protests to prevent threats to public order.
A Bench of CJI Surya Kant and Justice Joymalya Bagchi, hearing petitions arising from the Delhi protests, relied on its 1961 judgment in Babulal Parate v. State of Maharashtra, which upheld the corresponding provision under the old criminal procedure law.
The Court, however, directed the Centre to produce orders issued under Section 163 in New Delhi, apart from the August 23 notification.

#BREAKING on Bar & Bench
Supreme Court Bar Association (SCBA) has filed a criminal contempt petition in the Supreme Court against journalist Nikhil Wagle and Shiv Sena (UBT) Rajya Sabha MP Sanjay Raut over their remarks against Chief Justice of India Surya Kant.
Attorney General R Venkataramani granted consent for the action on October 15.
Wagle had posted "**** you CJI!" on X on October 11, quoting a post by The Hindu which reported that CJI Kant had rejected the INDIA bloc leaders' request for a meeting ahead of their march to the Supreme Court.
Raut, in remarks to the media carried by IANS on October 12, claimed that 60 to 70 judges, including the CJI, were seen playing badminton with BJP leaders in London.
The petition relies on a June 19 Delhi High Court order which found that the viral badminton photographs were from a November 2025 event in New Delhi, not London.

Sharp exchange in Supreme Court during the hearing of a petition challenging the denotification of Jantar Mantar as a designated protest site in Delhi.
As senior lawyers argued that the right to protest requires physical presence at a place where demonstrators can be heard, the Bench questioned whether technological advances had changed that understanding.
CJI Surya Kant also took exception to lawyers speaking over the Bench.
