Bakit naglabas ng arrest warrant laban sa isang beteranong mamamahayag na hindi umano nabigyan ng pagkakataong sumagot sa reklamong isinampa laban sa kanya?
Ito ang seryosong tanong na dapat masagot sa kaso ni Philip Lustre Jr., matapos manawagan si Ombudsman Jesus Crispin “Boying” Remulla na imbestigahan ng Department of Justice (DOJ) ang naging paghawak ng mga prosecutor sa Davao City sa kanyang cyberlibel case.
Ayon kay Remulla, kailangang alamin kung bakit hindi nakarating kay Lustre ang subpoena at iba pang dokumentong dapat sana ay nagbigay sa kanya ng pagkakataong ipagtanggol ang sarili bago umusad ang kaso.
“Kailangan maimbestigahan ng DOJ ’yan kung anong nangyari bakit hindi dumating. Anong nangyari sa subpoena, anong nangyari sa documents na ipinadala sa respondent,” ani Remulla sa mga panayam noong Oktubre 26.
Mas mabigat ang kanyang babala: posibleng ginagamit ang maling address upang hindi makatanggap ng abiso ang isang respondent, kaya dapat hindi basta umaasa ang mga prosecutor sa impormasyong ibinibigay ng nagrereklamo.
“May modus kasi ’yan, ’yung mga nagfa-file ng kaso, binibigyan ng wrong address ang prosecutor and sometime the prosecutor has to rely on the complainant,” pahayag niya.
Pero malinaw din ang paalala ni Remulla sa mga prosecutor: “Eh dapat hindi nangyayari ’yan. It should not happen.”
Dagdag pa niya, “Kailangan pag-aralan ng DOJ ’yan na hindi na mangyari.”
Ang punto ng Ombudsman: may tungkulin ang mga prosecutor na tiyaking tama ang address at maayos ang proseso. Hindi sapat na may dokumentong ipinadala kung hindi naman nasisiguro na nabigyan ng pagkakataong sumagot ang taong kinasuhan.
PHILIP LUSTRE, INARESTO BAGO RAW NAKASAGOT SA REKLAMO
Si Lustre, 72, ay inaresto sa Quezon City noong Oktubre 24 matapos maglabas ng warrant ang Regional Trial Court Branch 10 sa Davao City. Nagpiyansa siya ng ₱48,000 at nakalaya rin sa araw na iyon.
Ang cyberlibel complaint ay iniuugnay sa isang Facebook post noong Marso 6, 2026 na nagtatanong tungkol sa umano’y ₱300 milyong ibinigay ni Manases “Mans” Carpio, asawa ni Vice President Sara Duterte, para sa isang operasyon ng Marines na may kinalaman umano sa mga “bagman.” Ang alegasyon ay itinuturing na mapanira sa reputasyon ni Carpio. Ang mga paratang sa post ay hindi dapat ituring na napatunayan dahil lamang naging batayan ang mga ito ng reklamo.
Ayon kay Atty. Dino de Leon, abogado ni Lustre, hindi umano nakatanggap ang kanyang kliyente ng subpoena o abiso noong preliminary investigation. Dahil dito, wala raw siyang pagkakataong magsumite ng counter-affidavit o pormal na sagutin ang mga alegasyon bago umabot sa paglalabas ng warrant ang kaso.
Sa press conference noong Oktubre 28, sinabi ni De Leon na nakumpirma nilang si Carpio ang complainant.
“When we obtained the case information, we confirmed that the complainant was Atty. Manases ‘Mans’ Carpio, the husband of Vice President Sara Duterte,” ani De Leon.
Idinugtong ng abogado na kilala si Lustre sa pagtatanong sa pamilya Duterte, kabilang ang pagsusulat niya ng librong Kill, Kill, Kill tungkol sa drug war noong panahon ng administrasyong Duterte.
“Not a surprise because Ka-Ipe is a vocal person asking the most difficult questions against the Dutertes. He, after all, authored ‘Kill, Kill, Kill,’” dagdag niya.
Kinuwestiyon din ni De Leon ang umano’y dobleng pamantayan sa paghawak ng mga kaso.
“Why is there such double standards in this country? When it’s a Duterte or someone powerful, the treatment is different. When they’re the complainant, everything happens so quickly,” aniya.
CHIEF PROSECUTOR, INAMING MAY DUE PROCESS LAPSE
Hindi lamang si Remulla ang nagpahayag ng pagkabahala. Inamin din ni Prosecutor General Richard Anthony Fadullon na maaaring hindi nabigyan ng due process si Lustre dahil hindi siya nagkaroon ng pagkakataong sagutin ang reklamo.
“I would have to agree with them that they were not given due process as they were not given the opportunity to answer,” ani Fadullon sa panayam noong Oktubre 26.
Ayon sa paliwanag ni Fadullon, nakabatay umano sa lumang impormasyon ang address na ginamit sa pagpadala ng notice, kabilang ang detalye tungkol sa dating koneksiyon ni Lustre sa isang pahayagan. Dapat sanang beripikahin ng prosecutor ang mga impormasyong ito sa halip na basta umasa sa nakasaad sa complaint records.

It offends me to my very fucking core. I fucking hate it dude. I hate the expectation that we must all censor ourselves and bend the knee and accept this psychotic humiliation ritual every time the feelings of Han Chinese ultra-nationalists are offended over the slightest missteps. Their pathetic Third World mentality, this toxic mixture of ultra-aggression and arrogance born out of deep insecurity and resentment towards the West. It’s just so disgusting and repulsive to me on such a visceral level.
It’s funny, obviously I came up as a hardcore anti-CCP activist and people know me as some kind of hardcore “China hater.”
But as I became more right wing recently and “Lee Kuan Yew” pilled I was actually starting to gain a bit of newfound respect for China’s economic development and modernisation post-Deng Xiaoping - their YIMBY approach to development, their gleaming new cities, their beautiful high speed train system, their zero tolerance approach to petty crime which ensures they don’t have mentally ill crackheads wandering around stabbing people on the train like we have to endure in American cities. These are all parts of the Chinese system that I unironically have respect for and admire even as a longtime anti-CCP activist.
And I even have respect for some CCP leaders. Despite my longheld disgust for Tiananmen I overall have a lot of respect for Deng Xiaoping because he moved China away from the disasters of Maoism and embraced economic development.
I unironically greatly respect his pragmatism to the point that some of the Deng quotes are unironically my favourite political sayings:
“It doesn’t matter if a cat is black or white so long as it catches mice.”
“Hide your strength, bide your time.”
“Cross the river by feeling the stones.”
I unironically refer to these Deng quotes all the time and legitimately use them in my day to day life as quotes that guide me.
So their soft power was starting to work on me, I started to wonder whether I had been mistaken.
China opened itself up to tourism in recent years. Friends of mine started to visit China and reported back to me that they had seen technological marvels. That their Tier-1 cities were amazing. I started to wonder whether I had been wrong.
And then they come out with something like this - this deranged terror-censorship campaign to silence people in the West - and completely and instantly obliterate all their soft power for me in a second.
It instantly reminds me that the spirit of Third Worldism - this toxic cocktail of historical resentment, insecurity and racial hatred towards the West - still haunts China today.
This is not how a strong and confident nation behaves. Strong and confident people do not need to prosecute mass terror campaigns to censor foreigners living IN FOREIGN COUNTRIES. That’s the thing that disgusts me most about this all. How fucking dare you try tell us how to think and feel in our own countries? If a Westerner ran around Chinese cities insulting Mao, fine, I would legitimately accept you deporting them and kicking them out.
But how dare you try censor us in our own countries, speaking in our own languages, in our own internal discourse. How dare you prosecute this as a terror campaign. Fuck you. Such a disgusting and repulsive mentality.

The Chinese Embassy's latest statement about me is not a rebuttal. It is a self-portrait.
First, the Embassy is now a purveyor of fake news. Its own spokesperson and the FFCCCII said the Chinese teachers left because their families worried about Ray Powell's articles. My name was nowhere. On the "PR stunt," my statement thanked the PLA Navy, contrasted it with how the China Coast Guard treats our fishermen, and asked why a warship was in our EEZ. This is the same Embassy that circulated a garbled translation of my post to claim I "threatened" the Ambassador.
Second, the statement proves China does not care about international law. No UNCLOS, no 2016 Award, no legal basis. Instead: Iraq in 2003 and a Pompeo quote. A grievance against Washington does not explain a water cannon fired at a BFAR vessel in July or a survey ship off Batanes without the consent Article 246 requires. Every disclosure I make comes from PCG cameras and crews, not foreign intelligence.
Third, this is a mission that threatens rather than engages. The Ambassador said China could "easily win" by force; the DFA summoned him, the President called it a threat. The Embassy then warned of reciprocal action against our officials and answered a legitimate question with "the ignorant are fearless."
The Filipinos who actually pay a price are the fishermen water-cannoned at Bajo de Masinloc. My job is to show what our cameras record. If the footage is propaganda, your quarrel is with the footage. The Embassy can attack me all it wants; the cameras will keep rolling.

SARA’S DEFENSE CAUGHT IN ITS OWN 8-DAY TRAP
Sara Duterte’s defense team previously said it needed eight days per impeachment article. With the prosecution withdrawing three of the four articles, the defense now faces pressure to present its case more quickly.
Government records from the COA, BIR, AMLC, and SEC have raised questions about confidential fund spending, declared wealth, and financial transactions.
The defense must now address these issues with evidence as the trial moves forward. Attempts to prolong proceedings could draw further scrutiny, but the court will ultimately determine the merits of the allegations.
The challenge is clear: answer the financial questions with evidence, not just political arguments.
