Extremely intriguing new publication from cross-disciplinary team including @markbartholo pushing the ball forward on neuroscience in trademark law, focusing on neural imaging and efforts to measure confusion between visually similar trademarks: science.org/doi/10.1126/scia…

Excited to see our article “Trademarks and the Brain” w/@DrSandyV cited by @GraemeBD in his important & provocative argument against the “fetish” of empiricism papers.ssrn.com/sol3/papers.… While we disagree on the value of new empirical tools & primacy of consumer experience to TM /1
So fun chatting with The World Trademark Review (@WTR_Alerts, @timlince) about my article with Darren Cahr (@legallysocial) on Trademarks and the Brain!
Great to see The World Trademark Review (@WTR_Alerts) cover the research @DrSandyV and I have been doing on neuroscience and trademarks - with more research to come!

It was so amazing to present at the #intasymposium2022 with @DrSandyV on the neuroscience of trademarks - thank you so much to @lexlanham and @TimberlakeLaw for putting together such a fantastic conference, it was a blast!
what is distinctiveness? it's like tinkerbell in peter pan: trademarks only exist if you believe they exist. there's no real way to measure it. a source designation that conveys a basket of associations to your brain.
