MEDIA STATEMENT | South African government responsible for AGOA crisis – Lex Libertas Lex Libertas holds the South African government responsible for the reported decision by the United States to exclude South Africa from the African Growth and Opportunity Act (AGOA). The South African government knew that this was a possibility. President Cyril Ramaphosa even warned that the country should prepare for the consequences. Yet the government failed to take reasonable steps to prevent this outcome. These steps included addressing American concerns about incitement to violence against minorities, protecting property rights and promoting free-market policies. Instead, the government continued to prioritise its political ideology over the economic interests of the citizens of South Africa. 'This is shameful. The government anticipated the consequences of its decisions but chose not to address their causes,' said Dr Ernst Roets, Executive Director of Lex Libertas. According to Lex Libertas, the AGOA crisis illustrates a deeper structural problem: South Africa’s highly centralised political system has become detached from realities at community level and shields those in power from the consequences of their decisions. 'A political system in which ideological commitments consistently outweigh the interests of the people it governs, and in which political leaders are not held accountable for the consequences, is not sustainable. South Africa needs fundamental constitutional reform based on decentralisation and self-governance,' Roets concluded.

FIVE SUSPECTS NOW IN CUSTODY: EXCELLENT SAPS WORK IN DONOVAN MARX FARM ATTACK Five suspects, aged between 26 and 56, have now been arrested in connection with the attack on Donovan Marx near Ventersdorp. Two suspects were arrested on Saturday, 31 October, with a further three arrested today, 1 November, in Promosa near Potchefstroom. The first two arrests were made in the Ventersdorp area. Four firearms have been seized during the latest operation, two of which police have linked to the attack. Clothing and jewellery were also recovered. The five suspects are expected to appear in the Ventersdorp and Potchefstroom Magistrates’ Courts on Tuesday, 3 November, facing charges including house robbery, attempted murder and unlawful possession of firearms and ammunition. Congratulations to the Ventersdorp detectives, the Provincial Anti-Gang Unit and the investigating team led by Captain Bonita Dry. Their persistence, long hours and determined investigative work deserve recognition. I also thank the local farm watches, farmers, private security personnel and community members who assisted SAPS. This is what effective cooperation between police and communities can achieve. Five arrests in a matter of days are significant progress. The next step is a strong, properly investigated case that can withstand scrutiny in court. My thoughts remain with Donovan, Louise, their family and the farmworker who was also attacked. Their privacy and the integrity of the investigation must continue to be respected. Well done to every police officer and community safety role-player who contributed to these arrests. IC

This reprehensible parliamentarian, @Mngxitama2, should know that @afriforum’s legal team is coming for him in a big way. I have just instructed our legal team to determine the most appropriate legal course of action and proceed accordingly. These hateful statements about an Afrikaner farmer who was brutally tortured are no political game. We are prepared to commit every resource necessary to ensure that he is brought to book.

"Potholes will be there because we live in the situation of a climate change there are rains water the the streets get washed out." — ANC Secretary General, Fikile Mbalula Fikile Mbalula blaming potholes on "climate change" is the absolute peak of the liberation movement's cognitive shallowness. It is an embarrassing, logic-defying admission of governance bankruptcy. According to the ANC Secretary-General, road infrastructure doesn't collapse because of billions looted through inflated tenders, non-existent maintenance, or corrupt cadre deployment, no, the asphalt is simply suffering from a lack of revolutionary discipline under the rain. The performative nationalism of the ruling elite is pure aesthetics, a cheap smoke screen masking a brutal, predatory patronage state. Behind the fake patriotism is an executive machinery that has completely detached itself from the material conditions of ordinary citizens, surviving entirely on press briefings, luxury deployments, and a total refusal to account for public funds. When a liberation movement transitions from a governing majority into a desperate political entity, its entire apparatus shifts from state-building to aggressive excuse-manufacturing. Billions are allocated annually to infrastructure, only to be redirected into administrative overheads, legal battles, and shelf-company tenders given to political cronies rather than qualified contractors. Yet, when the state fails to deliver basic road networks, clean water, or functioning hospitals, nature itself is weaponized to excuse local government bankruptcy. If it is not the legacy of the past, it is the clouds in the sky. This isn't about identity politics or low-IQ rhetoric; it is about basic accountability, competence, and civil engineering. Municipalities lack technical capacity precisely because skilled professionals have been purged to make room for politically aligned patronage networks. The party model requires a weak state apparatus, because if institutions are robust, transparent, and merit-based, the illicit cash flows feeding the political elite instantly dry up. The normalization of this evil incompetence and lunatic corruption is embarrassing. When the highest-ranking administrative officer of a ruling party looks at a cratered, vehicle-destroying public road and attributes it to rain rather than a failure of governance, he is telling the electorate that basic standards of modern statehood do not apply to them. A nation cannot be built on historical nostalgia and performative "renewal" statements while its core infrastructure burns and a select few count the spoils of a captured state.

UPDATE: The amount of articles covering the horrific attack on and torture of farmer Donovan Marx on major South African media platforms such as @News24, @IOL, @eNCA, @SABCNews, @DailyMaverick, @mailandguardian, @Sowetan1981, and @City_Press remains at a shocking ZERO. These media outlets have blood on their hands for helping feed farm murder denialism and contributing towards the political cover-up of these grusome attacks. Next update tomorrow.
UPDATE: Still no coverage of the horrific attack on and torture of farmer Donovan Marx on News24, IOL, eNCA, SABC News, Daily Maverick, Mail&Guardian, the Sowetan, or City Press. Naked bias on display. The media are complicit in the farm murders/attacks cover-up.

Dear Rebecca Davis (@becsplanb), I watched your video on the Daily Maverick's YouTube channel. The one in which you spend 15 minutes circling around the idea that Lex Libertas has links to crazy right wing groups from the 1980s and 1990s without ever asserting it. It reminded me of the MSNBC stories suggesting that Donald Trump must be a Nazi, because he spoke at Madison Square Garden, and there were Nazis at Madison Square Garden in 1939. You should know that I genuinely burst out laughing when I heard you say that when we say that there is wisdom to be found in the past, even though the past is not a destination, it's (according to you) impossible to interpret that in any other way as an endorsement of apartheid. You then make it clear that your viewers should consider me as a racist despite the fact that (as you concede very explicitly) there is no evidence of any racism. I suppose you never considered just how shallow that type of reasoning is. It comes across as particularly desperate to make a political point in the absence of evidence. You reached out to me directly on October 8, asking if I'd be willing to agree to an interview. I agreed, and suggested dates, but you never responded. And so you continued with this skit without asking for comment and without reporting on the other side of the story. That's perfectly predictable behaviour for a political activist, but extremely unprofessional for a journalist.

Solidarity Movement rejects Ramaphosa’s accusation of unpatriotic conduct The Solidarity Movement rejects the accusations of unpatriotic conduct levelled against it by President Cyril Ramaphosa on Monday. These accusations are a transparent attempt to find a scapegoat for the government’s own diplomatic failures. Ramaphosa singled out the Movement as the reason for the deteriorating relationship between South Africa and the US, which threatens South Africa’s preferential trade status under the African Growth and Opportunity Act (AGOA). This is despite the Movement having spent months engaging in extensive discussions with the South African Presidency, the US Embassy in Pretoria and decision-makers in Washington to find solutions that will benefit everyone in the country. “For the past five years, we have been lobbying in the US for South Africa to remain part of AGOA, because it has become clear that pressure has been building in both parties in the US to expel South Africa because of ANC policies,” says Flip Buys, chairperson of the Solidarity Movement. “We stand on South Africa’s side, not that of the White House or Luthuli House. Although we disagree with the ANC, we love our country. That is why we do not speak ill of South Africa, even when we criticise the government. We aim to seek solutions to the ANC’s policies, which are holding the economy back and increasingly causing international tensions,” says Buys. Although several news publications have already had to apologise to the Solidarity Movement for false claims that the organisation promotes a ‘white genocide’ narrative abroad, Ramaphosa continues to blame the Movement for the ANC’s mistakes. Misinformation “The ‘misinformation’ label pinned on us is an attempt to deflect attention from the real issue – the ANC policies in question,” Buys explains. “The only ‘misinformation’ is the false claim that we spread misinformation about the country. No one has been able to provide any evidence to substantiate these accusations. It is absurd to think that a superpower such as the US, with all its intelligence services, does not know what is happening in South Africa and allows its policy to be dictated by ‘misinformation’.” The reasons for the US government’s hostile stance towards the South African government are set out, among other places, in the US-South Africa Bilateral Relations Review Act of 2025. They include: 1. Strategic alignment with US adversaries: South Africa’s ties with countries regarded as hostile to US interests, particularly China, Russia and Iran. 2. Engagement with terrorist organisations: South Africa’s interactions with Hamas. 3. South Africa’s increasingly hostile stance towards Israel. 4. Concerns about corruption and human rights: The US’s intention to identify senior South African officials and ANC members who may be involved in human rights violations or serious corruption. 5. Military cooperation: South Africa’s participation in joint naval exercises with Russia and China in early 2023, which is at odds with the country’s stated neutrality. “The seriousness of this long list of objections to the South African government predates Trump’s second presidency,” Buys emphasises. The facts Buys adds that the Movement consistently advocates constitutionalism, effective institutions and self-reliance, and has often stepped in where the government has been absent or ineffective. In response to the false accusations, the Solidarity Movement sets out the facts: 1. We have not claimed that large-scale state-led land expropriation is already taking place in South Africa. 2. We have never asked the US to cut funding to South Africa or impose sanctions on the country. 3. We have actively opposed South Africa’s removal from AGOA and shared research with the US Embassy on the economic risks facing the country. 4. We have urged the US not to punish South Africans for the ANC’s actions, but rather to take action against individual ANC officials implicated in corruption. The Zondo Commission reportedly identified 97 ANC members who should be investigated. Yet meaningful progress remains elusive, highlighting a troubling lack of accountability. 5. We are indeed in dispute with the ANC because our constitutional human rights are being trampled on by the country’s extensive race-based legislation. We also disagree with the ANC over the government’s breach of an agreement on this legislation reached through the mediation of the International Labour Organization (ILO), the breach of the constitutional understanding on Afrikaans education, and the breach of agreements with us on these matters. We believe the ANC is seeking to deprive us of our cultural rights and spaces. All of this makes us second-class citizens, even though we are first-class taxpayers and are governed as though we were in a Third World country. 6. Mr Ramaphosa has repeatedly said that South Africa must find South African solutions to South African problems, yet he refuses our requests for talks and breaches agreements reached with the Presidency. 7. We are proud South Africans and patriotic Afrikaners, committed to the country’s future and willing to help restore sound relations between the US and South Africa. It is time for the Government of National Unity (GNU) to determine the country’s policies, rather than the ANC alone. “We reaffirm our unwavering loyalty to South Africa and reject any claims that our actions – taken in the national interest – are unpatriotic simply because we disagree democratically with the ANC’s disastrous policies,” Buys concludes.

This is truly astonishing! The Chairperson of the Portfolio Committee on International Relations and Cooperation issued a press statement in response to a letter by @LexLibertasOnX. In this statement, he quotes section 16 of the South African Constitution (the right to freedom of expression). He says, and I quote: "Freedom of expression under Section 16 does not include propaganda for war, incitement to imminent violence, or advocacy that seeks to deliberately misrepresent the country for material advantage." But that is NOT what the Constitution says. Let me quote section 16(2) of the Constitution (the part he refers to in full). This is what the Constitution actually says: "(2) The right in subsection (1) does not extend to— (a) propaganda for war; (b) incitement of imminent violence; or (c) advocacy of hatred that is based on race, ethnicity, gender or religion, and that constitutes incitement to cause harm." So the Parliamentary Portfolio Committee swopped the subsection that says advocacy of racial hatred with the intention to cause harm is unconstitutional with their own made up subsection which says that misrepresenting the country is unconstitutional. Will publish our response soon.

R623 million went to people SASSA cannot even confirm ever existed. R502 million went to government employees that put themselves on grants on top of their salaries. This is not just ANC Elites stealing money. This everyone, from the lowest to the highest level government employees participating in the loot. Solidarity wins case against race-based codes in the legal sector Solidarity has won a High Court case against the Minister of Trade and Industry’s race-based codes for the legal sector. The codes were declared invalid, and the minister must pay Solidarity’s legal costs. Several major law firms joined Solidarity as co-applicants. According to Dr Dirk Hermann, chief executive of Solidarity, the ruling is a major victory against the government’s reckless racial policies. According to Solidarity, the sector codes, which came into effect in September 2024, amounted to racial scorecards for the workplace, with far-reaching implications for law firms of all sizes. One of the most controversial changes was the lowering of the threshold for “exempt enterprises” to an annual turnover of less than R5 million. This meant that even smaller firms had to comply with stringent requirements. Solidarity argued that the sector codes were unlawful, irrational and unconstitutional. According to Solidarity, the codes not only undermine the independence of the legal profession but also impose an unrealistic administrative and financial burden on legal practitioners. Solidarity also argued that the public consultation process was flawed. According to Anton van der Bijl, head of Solidarity’s legal services, 76% of the comments opposed the codes, but those comments were simply ignored. According to Van der Bijl, the court found that the minister’s decision to issue the codes was irrational and that he had failed to comply with statutory and constitutional requirements. The codes were therefore set aside with costs.

They've learnt zero lessons and no second chances will be coming either... Next month you'll be taught the biggest lesson of your lives by an electorate who's hospitality you've abused for 30 years
ANC SG Fikile Mbalula says the party has “learnt its lesson” and is asking voters for another chance ahead of the 2026 local elections. He acknowledged corruption and weak leadership, saying only 15% of municipalities achieved clean audits in 2024/25.

When you strip away the revolutionary songs, the red berets, and the dramatic stage walks, what you're left with isn't a freedom fighter. You're looking at one of the most successful commercial operations in modern African politics. Julius Malema figured out a dark truth early on: in a country broken by poverty, selling hope and anger pays much better than actually fixing anything. Think about the sheer contradiction of it. You stand in front of a crowd of desperate, unemployed youth in a dusty township. You look people in the eye who don't know where their next meal is coming from, and you promise them that you're going to tear down the system and give them the land. They cheer for you because they are desperate for a savior. They genuinely believe you are fighting for them. But watch what happens the minute the cameras turn off. The red overalls come off. The luxury German SUVs roll up. Malema goes back to a multi-million rand mansion in Sandton or Hyde Park, the most elite, capitalist suburbs in the country. He sips five-figure French champagne, wears designer Italian shoes, and rocks watches that cost more than a family's lifetime earnings. His kids go to elite private schools while his supporters' kids deal with broken public education. How is this lifestyle funded? It's not from a standard salary. It's funded by the very systems of corruption and political tenders he claims to hate. Look at the VBS Mutual Bank scandal. That wasn't money stolen from the wealthy; that was money stolen from poor, elderly grandmothers in Limpopo who lost their life savings. And where did a chunk of it trace back to? Luxury boutiques and lifestyle funding for the EFF inner circle. The wildest part is the followers, the useful idiots who will still jump to defend him. They will live in a shack, drink dirty water, and attack anyone who questions their leader's luxury drip. Malema isn't crazy. His behavior looks like a clown show to sober-minded people, but It's completely deliberate. He keeps people angry and radicalized because if South Africans ever stopped, calmed down, and started thinking logically, his entire business model would collapse. Being a sober, constructive leader doesn't buy mansions in Sandton. Exploiting the pain of poor people does. It's a beautifully executed scam.

Without exception, liberation movements in Africa have become extremely dangerous during their political decline. The ANC is losing power across South Africa. Its legacy, too, is in tatters as its skeletons emerge from the closet. The result is internal strife, but increasingly also paranoia, conspiracy theories and the politics of scapegoating. This creates a tragically explosive situation for South Africa over the next few years. The only solution lies in strong communities working together to create solutions (economic, safety, etc) and decentralize practical political power through self-determination. However, strong international ties that underpin and reinforce this cooperation are also essential.
