“Lozza” thinks he’s being clever by saying the courts can’t define what “racist” means. What his intellectually challenged rhetoric (on his timeline post) fails to take into account is that many terms, including pejorative ones, are defined by the courts on a case by case basis. There is no single definition of the word “racist” just as there is no single legal definition of the word “reasonable” because judges and juries exist to interpret facts and words. Ultimately, the ratio decidendi and obiter dicta of individual cases will define how semantics are applied in different cases to create a structure of precedent… which, if Lozza spent less time losing and more time learning, he would have realised.
