The below directives have been instituted as of 9/25/2026.
All illegal aliens without criminal history will NOT be arrested.
All illegal aliens WITH a final order of removal, which there are over 5M, will NOT be arrested. A Final Order of Removal means that illegal alien has already been given every legal means to stay in America BUT the judge still deems that person is illegally in the U.S. and thus orders that person removed is now NOT allowed to be arrested!
All illegals that have already been deported and returned to the U.S. and do not have criminal history will NOT be arrested.
Let me give you a real-life ICE/Border Patrol scenario that happens every day:
I pull over a van, and the driver is my target but there are 8 other people in the van. I determine that all 8 people are illegal aliens with prior deportations and with final orders of removals BUT I can't determine what, if any, criminal history they have, then I DO NOT ARREST THEM, INSTEAD, I RELEASE THEM BACK INTO AMERICA!
