🏚️Thank you @minterellison for this note bringing attention to Whitaker v FP & HS Keogh Pty Ltd [2024] VCAT 708: important consideration of Stone v Chappell (2017 SASCFC) reasonableness factors in awarding rectification damages for defective building work constructionlawmadeeasy.com/…
🏚️I must say I am particularly grateful to Senior Member Edquist for his detailed engagement with the Stone factors (see [125]-[141]): it is, with respect, exactly what I was hoping for when I wrote my 2022 @SCL_UK Hudson Prize paper on those factors austlii.edu.au/cgi-bin/viewd…
🌇Thank you, @katelamble and panellists: a superbly insightful discussion of the Grenfell Tower Inquiry report.
So much for us in construction and regulation to learn including, as you note, whether profit and safety can be effectively balanced. podcasts.apple.com/au/podcas…

The Grenfell Inquiry report isn't just a story of a complacent government. Read it carefully and a story emerges of one which routinely covers up the truth

A reminder of a report I did in June: there are millions and millions of square metres of the ACM used on Grenfell on buildings globally - much of it in jurisdictions which have done nothing to look for it post-fire

A passing thought that there are people out there who will be reading the inquiry report and quietly knowing they were on the right side of history, even though it made them unpopular, cost them opportunities and saw their views dismissed. If faced with the choice, be like them
Thank you @PeteApps for this early summary of the landmark Grenfell Tower Inquiry final report. It immediately shows the prescience of your Show Me the Bodies book.
Much to digest for everyone interested in building regulation around the world, including for us in Australia.
🌏Ch 112 Grenfell Tower Inquiry final report summarises reforms around the world - including the Australian programs following the Shergold-Weir report and 2014 Lacrosse cladding fire in Melbourne.
The issues are global: solutions need to be as well.

The final report from Grenfell Tower inquiry found the disaster was the culmination of “decades of failure” by governments and others in the construction industry.
It sets out a ‘path to disaster’ stretching back to the early 1990s and criticises organisations at every level.

Super interesting, thx for posting. @MelbConstrucLaw @atmesisb So much law happens behind confidential settlements that the boundaries don't get publicly tested.
Contractor has received at least £45m in settlement of claim against Kingspan & others 👇
This could have been an important case to establish how claims against cladding manufacturers will work.
