I've been getting blown tf up with questions about the Silencer Shop v. ATF case and I have been traveling, so I have not had a chance to respond. First, as usual, I am not your lawyer, this is not legal advice. And I very well could be wrong on a thing or two below. 👇 That said, here is the simplest way I can explain, but these are just the main points. I won't be able to get to everything because this is complex, even by gun lawyer standards. Did you know this is actually two consolidated cases, and, depending on which member group you belong to, you get different relief? AOWs are treated differently among plaintiff groups, for example. 1) I should start with the most misunderstood point. YES, 15 states were plaintiffs. NO, you are not conferred special boy status for living in one of those states. State-plaintiff status protects the state gov. It does not protect the residents of that state. A Texan is not covered because he lives in Texas. He is covered because he is a member of one of the plaintiff orgs or not at all. THUS, if you are not a member of one of the plaintiff orgs, then no need to read further. Nothing changes for you (yet). 2) The NFA was not "struck down.” It does not deregulate machine guns or destructive devices. SBRs and SBSs are a MESS right now. There's a federal law complication: The GCA/18 USC 922 which was not touched by this decision still technically restricts an FFL from delivering them without federal authorization. 3) And some states still independently require NFA registration. Yes, even the "good" states! For example, Mississippi Code § 97-37-31 holds that you can't own a silencer unless "duly authorized by federal law." Alaska state law requires NFA registration to own a silencer. These are inconsistent now and possible traps, although let's be honest - is Alaska or Mississippi really going to assblast you for this if you are otherwise considered part of the plaintiff orgs? Probably not, but you could always be the test case... 4) If you have an NFA trust, you might also not be getting anything anytime soon. A trust, LLC, or corporation is almost certainly not included in this ruling merely because a trustee/RP is in a plaintiff group. 5) If you are actually one of the people protected by the injunction, the biggest immediate practical effect is on suppressors. In a state that does not independently require NFA registration, you may now be able to buy a suppressor from an FFL essentially like an ordinary firearm. 4473, NICS check, take it home. No Form 4, no fingerprints, no photos, no CLEO notification, no NFA registration, and no waiting on ATF approval. 6) So what did we win, exactly? Congress reduced the NFA making/transfer tax on silencers, SBRs, SBSs and AOWs to $0 in the BBB. The court held that the registration and approval system was enacted to administer a tax, and a $0 “tax” raises no revenue. Therefore, as to the plaintiff parties, the government can’t continue enforcing those registration/approval provisions under Congress’s taxing power. The court did not reach the Second Amendment question.
