Big opportunity for Supreme Court to correct what Justice Alito called the Fourth Circuit's "flagrantly wrong" decision in Coalition for TJ v. Fairfax County School Board (the circuit precedent that the panel in the MD school case was obligated to follow).
PLF is going to SCOTUS! The Supreme Court just granted @PacificLegal’s challenge to a MD school admissions policy, which was designed to reduce Asian admissions. pacificlegal.org/wp-content/…

4/ “The Constitution protects students as individuals, not as members of a racial group,” said senior attorney Chris Kieser. “A school district should not be able to defeat a discrimination claim by showing that its policy did not harm enough Asian American children.”

BREAKING: The National Marine Fisheries Service calls California's Santa Maria River "occupied critical habitat" for steelhead even though the fish have been gone since the 1940s and much of the riverbed is dry year-round. We've petitioned NMFS to rescind the designation.

2/ If an area can’t sustain a species, the government can’t cite the Endangered Species Act to impose restrictions that hinder the productive use of land. The Santa Maria River lacks the conditions needed for steelhead.

3/ NMFS’s analysis concluded that steelhead habitat designations across California could have a negative economic impact of nearly $30 million annually. It’s time to follow the evidence and rescind the Santa Maria River’s critical habitat designation. pacificlegal.org/case/petiti…

Rob Dunn spent three years asking every agency he could find to stop a culvert from flooding his family's farm in Vermillion, Ohio. When a county official told him to fill the low spot himself, Rob did. Now the Ohio EPA is suing him to remove the fill and let his property flood.

The Ohio EPA claims the seasonal low spot is a protected "water of the state." It is not. In Sackett v. EPA, the Supreme Court ruled that federal water regulation extends only to relatively permanent waters such as streams, rivers, and lakes.

Sackett drew a line that lets the government protect real waters while leaving landowners free to make their property productive. Ohio chose to follow that line, and the Ohio EPA cannot ignore state law to control what a landowner does with his property. pacificlegal.org/case/dunn-f…

LAWSUIT: A dental office fired an employee after they delivered a profanity-laced rant to a coworker. The NLRB charged the office, tried it in the agency’s court, fined the company, and mandated that the office rehire the employee.

2/ The Constitution did not give the Board the power to decide the case by itself. A dispute between two private parties over money belongs in a courtroom, with an independent judge and a jury. pacificlegal.org/case/aqua-d…

This is an underrated issue that @PacificLegal has been working on for a long time. Everyone east of the Mississippi (save some lobstermen in New England) have no idea how bad this stuff is. Thanks for the bill, @RepGosar and for the PLF shoutout!
My bill provides much needed reforms and will restore a greater role for Congress in decisions involving large areas of federal land and provide clearer limits on presidential authority under the Antiquities Act. Read more here 👇👇 washingtonexaminer.com/resto…

Senate leaders from both parties released the Bipartisan American Affordability and Jobs Act. It would streamline federal permitting under NEPA, the Clean Water Act, and the Endangered Species Act. PLF urges Congress to pass it quickly.

Pacific Legal Foundation research has found that, under NEPA, geothermal environmental assessments take more than 500 days on average, while mine permitting in the United States takes an average of 29 years—the second longest of any country in the world, behind only Zambia.

LAWSUIT: Minnesota says it wants less plastic waste. But when Simon Milne developed a boat wrap designed to biodegrade in landfills, state law put his competitors in charge of whether and how he can sell it. We just filed a lawsuit to stop this.

3/ Minnesota’s 2024 law requires boat wrap producers to join and finance an organization governed by bioaqualife’s largest commercial competitors, with the sweeping power to write statewide rules, set collection quotas, and levy producer fees.

4/ Minnesota’s law punishes bioaqualife for offering a better environmental solution because it doesn't fit the State’s one-size-fits-all recycling mandate. Entrepreneurs deserve the freedom to solve problems with innovation. pacificlegal.org/press-relea…
