Sullivan rejected the request, ruling that information discovered AFTER a mistrial cannot be used to retroactively challenge whether declaring it was justified. He also rejected arguments that the jury foreperson’s notes were ambiguous and denied a request to postpone the upcoming hearing. What’s next? November 2: The court is scheduled to hear arguments on Clancy’s motion to dismiss the three murder charges on double-jeopardy grounds, along with a separate motion concerning juror records.
