In its Form 8937, the company stated it expects the warrant dividend to common shareholders to be treated as a nontaxable distribution under Section 305(a). (Treatment for the warrants issued to convertible noteholders on an as-converted basis was noted as more uncertain and potentially governed by debt rules instead.)
