While a husband and wife cannot normally be charged together under the offence of ‘conspiracy’, they can still be charged with the offence if they are found to have been engaged in a conspiracy with another party or parties unknown to the prosecution, the Supreme Court has ruled.
The Supreme Court gave its ruling following its deliberations into an objection raised by a husband and wife duo, who had argued that they could not be charged together under the offence of conspiracy over a case filed against them for investing funds allegedly obtained through fraudulent means in the United States.
The accused, Rienzie Mahesh Kumara and Punya Priyanji Manike, who had been indicted in the Colombo High Court, had raised a preliminary objection during the trial, arguing that the case filed against them on the charge of ‘conspiracy’ could not be maintained because they were husband and wife. @TimesOnlineLK
