New from ISP fellow Madhavi Singh: “The Government Should Bring the Next Case Against Google for AI."
thesling.org/the-government-…
Mark Glick, Gabriel Lozada, and Darren Bush (GLB) express gratitude to @BrianCAlbrecht and @ErikHovenkamp (A&H) for engaging with their work.
But GLB have (major and minor) disagreements with A & H, both in terms of matters of economic theory and in terms of antitrust policy.
Consumer welfare can weigh higher prices against better quality using observable data. What evidence could rebut a claim that a merger “threatens democracy”?
@BrianCAlbrecht & @ErikHovenkamp explain why a “welfare dashboard” lacks a shared way to resolve these conflicts. 🔗⬇️
The draft paper is here.

Forthcoming, in @geomasonlrev in 2027. The authors thank GMU L. Rev. for promoting intellectual discussion. Comments welcome.
Good morning!
In her latest post, @eyreflare argues that Google is exploiting its monopsony over publishers to acquire content on the cheap, and its AI competitors should sue.

Learned so much about the dangers of the growing private legal system speaking with @brendan_ballou, author of the book "When Companies Run the Courts: How Forced Arbitration Became America's Secret Justice System" (2026).
Here's a teaser from our Slingshot interview, where I asked Brendan just how pervasive these provisions are in customer and employee contracts.

The dismissal of the Helena, Chegg, and Penske lawsuits is a setback for publishers but not the end of the story.
My latest in @TheSlingOrg argues that the court rejected the theories pleaded, not every possible theory. A case of this scale should be brought by the government.

Remember when neoliberal econs told us in the post-Covid period that companies were NOT taking advantage of inflation to raise their own prices in excess of any cost increase? They also told us that industry concentration didn't explain post-Covid price hikes. Well, economists at Northeastern University tested that proposition and found good evidence for this practice--what non-econs might call "gouging" or "profiteering"--in the airline industry. Go give it a read! (link in next tweet)

Sports economist David Berri @wagesofwins explains in @TheSlingOrg how 77 U.S. Senators were duped into voting for the Protect College Sports Act. With luck and more attention to its defects, the measure will fail to pass the House.
Berri provides six facts about the economics of college sports that the Act's proponents (hello @tedcruz) either don't understand or intentionally ignore.
Here's a preview, containing my favorite line.
According to a recent defense of law and economics, contemporary practitioners have abandoned the idea that law should maximize economic efficiency.
To put this claim to the test, Darren Bush, Mark Glick, and Gabriel Lozada reviewed twelve major law and economics textbooks.

In the latest episode of the Slingshot, Darren and I interview @arindube about his book, "The Wage Standard: What's Wrong in the Labor Market and How to Fix It." In this segment, I ask Arin about the harms from outsourcing, and he tells the story of Frank Morley, a contract custodian at Harvard and member of the Harvard Living Wage Campaign.

For @TheProspect, I reviewed @owenslindsay1's thought-provoking new book, "Gouged: The End of a Fair Price and What That Means for Your Wallet."
Here's how the review begins. Apologies to neoliberal economists in advance.

NEW: Our @DylanGyauchL has a review of @IsabellaMWeber's Anti-Fascist Economics and @owenslindsay1's Gouged out in @TheSlingOrg today! Together, the books help to reclaim a tradition of economic policy designed in the public interest.

"Rather than merely wanting to hold fascism at bay, Weber wants to marshal a whole-of-society effort to stamp out the conditions that enable it in the first place."

For @TheSlingOrg, I reviewed new books from @owenslindsay1 and @IsabellaMWeber, two of my personal econ policy heroes!
The two of them are working to recenter human welfare in economics and just maybe save the discipline from itself. 1/7
In case you missed it: Hal Singer's take on Paramount. Check it out.
I have a different take on how we arrived at the horribly rotten outcome in the Paramount case. The Trump administration’s deal with the Hollywood giant is only one example of his interference in DOJ's investigations. In several instances, career staff, tasked with enforcing the antitrust laws and often with decades of experience of doing just that, have been sidelined by their politically appointed bosses. Given Trump's transactional nature, and given evidence of a quid-pro-quo for other regulatory relief, it is time to start asking how to prevent the monetization of the White House.

Tuesday is coming fast (and if anyone has tips for not losing your voice while talking all day and night I need them) but one of the absolute best part of this journey is talking to people who have already read your book! Don’t miss this fantastic convo with @halsinger and @DylanGyauchL
Had the pleasure of interviewing Lindsay Owens (@owenslindsay1), about her new book, "Gouged: The End of a Fair Price--And What That Means for Your Wallet" on The Slingshot.
Here's a snippet where Lindsay explains the simple yet powerful role of the price tag in protecting consumers. And how surveillance pricing threatens that protection. Go give it a listen!
