Ce vendredi 30 octobre, des dizaines de policiers ont été déployés devant le Tribunal constitutionnel à Varsovie. Des manifestants se rassemblent et le président polonais Karol Nawrocki a interrompu son voyage vers le Sénégal, ordonnant à son avion de faire demi-tour.
POUR COMPRENDRE, IL FAUT REVENIR EN ARRIÈRE.
De 2015 à 2023, la Pologne était gouvernée par les conservateurs du PiS. En 2023, Donald Tusk, pro-européen, arrive au pouvoir.
Mais les conservateurs conservent une influence dans plusieurs institutions, notamment au Tribunal constitutionnel, l'équivalent approximatif du Conseil constitutionnel français.
Le gouvernement Tusk conteste certaines nominations de juges effectuées sous les conservateurs et souhaite réformer la justice. Le PiS l'accuse de vouloir prendre le contrôle des institutions.
EN 2026, LE CONFLIT S'AGGRAVE.
Le Parlement désigne six nouveaux juges. Le président conservateur Karol Nawrocki refuse de recevoir le serment de plusieurs d'entre eux, contestant leur nomination.
De son côté, le président du Tribunal constitutionnel, Bogdan Święczkowski, refuse de les laisser exercer.
CE VENDREDI, LA SITUATION EXPLOSE.
Une magistrate, Anna Korwin-Piotrowska, dont la légitimité est contestée par la direction du Tribunal, annonce la suspension pour un mois de son président et de son vice-président.
Dans le même temps, le procureur général transmet cinq demandes de levée d'immunité visant ces deux responsables.
Des policiers sont déployés devant le bâtiment. Le vice-président du Tribunal serait empêché d'y accéder.
La police affirme intervenir uniquement pour maintenir l'ordre et assurer la sécurité. Elle dément toute prise de contrôle du bâtiment.
Mais l'opposition conservatrice dénonce une opération illégale.
LE CHEF DE L'OPPOSITION PARLE D'UN "COUP D'ÉTAT".
Jarosław Kaczyński, dirigeant du PiS, se rend sur place et accuse les autorités de mener un "coup d'État progressif", désormais entré dans sa phase décisive.
Des appels à rejoindre Varsovie se multiplient.
Face à la situation, le président Nawrocki interrompt son déplacement officiel et rentre immédiatement en Pologne.

Poland is heading into a full-blown CONSTITUTIONAL SHOWDOWN.
Police have been deployed to the Constitutional Tribunal in Warsaw, its president Bogdan Święczkowski has reportedly been suspended, and President Karol Nawrocki was so alarmed he TURNED HIS PLANE AROUND on the way to Senegal.
Now things are getting seriously ugly.
Prime Minister Donald Tusk says he's restoring the rule of law after years of political interference in the courts.
His opponents are calling it an attempted COUP.
Święczkowski's camp is even disputing the suspension itself, insisting he remains the tribunal's legitimate president.
Police say they were there to maintain security, not seize the court.
So Poland now has rival camps disputing who can legitimately exercise authority over the country's highest constitutional court.
And a president who has abandoned a foreign trip to deal with it.
This is no longer just another argument between Poland's politicians. It's a fight over who gets to enforce the Constitution.

Un communiqué publié vendredi 30 octobre sur le site du Tribunal constitutionnel polonais annonce la suspension de son président, Bogdan Święczkowski, et de son vice-président, Bartłomiej Sochański. Dans la soirée, la police a empêché Bogdan Święczkowski d'entrer au Tribunal. Son camp dénonce un « coup d'État », et le président Karol Nawrocki a interrompu un déplacement à l'étranger pour rentrer à Varsovie.
⭕️ La suspension a été décidée par la juge Anna Korwin-Piotrowska, qui assure l'intérim. Elle fait suite à cinq demandes de levée d'immunité transmises par le procureur général Waldemar Żurek. Quatre visent Bogdan Święczkowski et une vise Bartłomiej Sochański, pour un dossier de 224 pages réparti en 50 tomes, rapportent Reuters et Euronews Polska.
⭕️ Le compte X du Tribunal, resté aux mains du camp de Bogdan Święczkowski, dénonce une « prise de contrôle illégale du site ». Il affirme que Bogdan Święczkowski reste président et conteste le statut d'Anna Korwin-Piotrowska. Vers 18 h 25, il a écrit : « Toutes les personnes participant à ces actions commettent le crime de coup d'État. » Le chef du PiS, Jarosław Kaczyński, évoque un « attentat contre le Tribunal constitutionnel » et estime que la Pologne devient un « État policier ».
⭕️ Le gouvernement défend une démarche tout autre. « Rétablir l'État de droit est notre devoir. Après des années d'arbitraire du PiS, c'est un processus difficile, parfois douloureux, qui exige une action résolue. Il n'y a pas d'autre voie », a déclaré Donald Tusk. Selon Waldemar Żurek, la police est venue à l'appel des « juges légaux », et « l'attentat contre le Tribunal a été commis il y a bien des années ».
⭕️ La police a été déployée avenue Szucha, à Varsovie, après des courriers de Waldemar Żurek et d'Anna Korwin-Piotrowska signalant des menaces liées aux manifestations. Les policiers sont entrés dans l'enceinte après avoir été visés par des jets d'objets dangereux, mais pas dans le bâtiment, selon TVN24. Trois personnes ont été interpellées, alors qu'un rassemblement de la droite et du PiS se tenait devant la grille. Peu après 20 h, Bogdan Święczkowski a franchi la grille, mais le cordon de police l'a arrêté et il s'est retiré, rapportent TVN24, WP et Onet.
⭕️ Karol Nawrocki, qui volait vers Dakar, a fait demi-tour au-dessus de l'Espagne.
« À un tel moment, le président doit être en Pologne. J'interromps mon vol vers le Sénégal. Je rentre », a-t-il déclaré. Son atterrissage à Varsovie est prévu vers 21 h, et il pourrait se rendre au Tribunal.
⭕️ Cette crise s'inscrit dans un long conflit. Karol Nawrocki refuse d'assermenter les juges élus par la majorité de Donald Tusk, et Bogdan Święczkowski bloque leur entrée en fonction, ce qui paralyse le Tribunal.

Poland's Constitutional Tribunal is being subjected to an extraordinary takeover operation by pro-EU Prime Minister Donald Tusk.
Its official website has been taken over, an announcement has appeared removing its president and vice-president from their duties, and police have been deployed around the institution.
The Tribunal's existing leadership has declared the operation illegal and accused those responsible of committing a coup d'état.
The Constitutional Tribunal is the institution responsible for reviewing whether laws comply with the Constitution. It is broadly comparable to the constitutional-review function of the United States Supreme Court.
Today, its website announced that President Bogdan Święczkowski and Vice-President Bartłomiej Sochański had been suspended for one month.
The person now claiming authority over Poland's Constitutional Tribunal is Anna Korwin-Piotrowska, elected to the Tribunal by Donald Tusk's parliamentary majority in March 2026.
But there is a fundamental legal problem: she has never taken her judicial oath before the President of Poland, Karol Nawrocki.
Under Article 4 of the Act on the Status of Constitutional Tribunal Judges, newly elected judges must take their oath before the President of the Republic.
Nawrocki refused to receive her oath. Instead, on April 9, Korwin-Piotrowska participated in an alternative swearing-in ceremony organised inside the Polish Parliament, without the President's presence or participation.
The Presidential Chancellery explicitly declared that this procedure had no legal basis and could not confer judicial authority. The existing leadership of the Constitutional Tribunal maintains that she is therefore not legally a judge of the institution.
And now, a woman whose authority to serve as a constitutional judge is rejected by the President and the Tribunal's existing leadership is being presented as the person entitled to take control of the entire court.
Poland's Constitution does not give the prime minister or his government the power to dismiss the Constitutional Tribunal's leadership.
Article 194 establishes the Tribunal's composition and the procedure for appointing its president. Article 195 guarantees the independence of its judges.
The announcement of a suspension relies on Article 130 of the law governing ORDINARY COURTS. Invoking this article to suspend the leadership of the Constitutional Tribunal is a legally indefensible distortion of the law, revealing a staggering disregard for elementary constitutional principles.
HOW DID POLAND GET HERE?
Donald Tusk returned to power in December 2023, promising to reverse the judicial reforms introduced under the conservative Law and Justice government.
Those reforms had been fiercely opposed by the European Commission, which initiated rule-of-law proceedings against Poland and linked access to European funding to judicial conditions.
Tusk's government subsequently presented Brussels with a programme for restructuring the judiciary, including the Constitutional Tribunal. The European Commission welcomed that programme and ended its Article 7 proceedings against Poland in 2024.
The methods used by the EU and its supporters undermine the very constitutional principles they claim to restore.
President Karol Nawrocki has reportedly interrupted his journey to Senegal to return to Poland.

Coup d'état underway in Poland after EU-aligned Prime Minister Donald Tusk sent police forces to the Constitutional Tribunal in Warsaw right after President Nawrocki left for Senegal for a diplomatic visit.
Nawrocki is currently headed back to Poland.
The President of the Polish Constitutional Tribunal in Warsaw, Bogdan Swieczkowski, was suspended and possibly arrested. He is a known support of President Nawrocki.
Several right-wing Polish MPs and their supports are reportedly on their way to the Constitutional Tribunal to defend the institution from being taken over by Donald Tusk.
Warsaw's police forces are preventing the President of the Constitutional Tribunal Bogdan Święczkowski, members of the Sejm and protesters from entering the Constitutional Court.
