Every day, American workers face discrimination simply because they’re American. Laid off and told to train your replacement—a guest worker visa holder? Passed over, excluded, or harassed just because you’re American? That’s national origin discrimination. It’s illegal, and the EEOC is fighting back to protect workers of ALL races who are American.

This morning on @FoxBusiness, Chair @AndrealucasEEOC made clear: yesterday’s $5 million settlement with Instacart is just the start of our work to tackle unlawful PERM abuse and other employment schemes that boost cheap foreign labor at the expense of American workers. As Chair Lucas emphasized, “American workers have rights, and we are going to robustly enforce the law on their behalf.” Under the Trump administration — the @USEEOC alongside @TheJusticeDept and @USDOL are putting an end to this and delivering long overdue justice to American workers.

🚨 $5 MILLION SETTLEMENT: @USEEOC and @theJusticeDept @CivilRights secure major action against @Instacart for allegedly discriminating against American workers. Thank you to @AAGDhillon for your partnership in achieving this great result for a class of American workers, comprised of affected applicants and deterred applicants to Instacart. The agencies found evidence that Instacart’s PERM recruitment practices favored temporary visa holders and created unlawful barriers for U.S. and American workers applying for jobs. Up to $4 million will be available for affected applicants and deterred applicants, with an additional $1 million in civil penalties.

“The freedom to live and work consistent with one’s faith is a fundamental American principle, and employees should not be forced to choose between their religious convictions and their livelihoods.” - Chair @AndreaLucasEEOC Following an @USEEOC investigation, a pediatric healthcare provider agreed to pay $650,000 and take other corrective action to resolve a charge alleging it failed to accommodate an employee’s religious objection to performing work related to sex-rejecting medical procedures.

@USEEOC found reasonable cause to believe the City of O’Fallon, Illinois discriminated and retaliated against a woman over access to a women’s locker room. The city agreed to a five-year resolution, ensuring: -Locker room and shower facilities are designated as “Women” and “Men” -Distribution of policies prohibiting discrimination -Employee training about the employer’s legal obligations regarding harassment -Employee notification about this resolution

“Failing to provide women with sex-designated facilities can constitute unlawful sex discrimination and expose employees to harassment. The EEOC will continue to vigorously enforce these longstanding protections and hold employers accountable when they violate the law.” – Chair @AndreaLucasEEOC Learn more: eeoc.gov/newsroom/eeoc-defen…

Sexual harassment has no place in the workplace. Il Fornaio will pay $3 million to settle an @USEEOC lawsuit alleging widespread sexual harassment of female employees, including teenagers, and retaliation against workers who complained. Employers must comply with federal law.

Like @VP, I understand exactly the game that is being played when companies prefer H1B workers over Americans: “They’re creating basically a bunch of serfs that they can push around.” More on @VP’s comments below: "I’m sure that everybody here understands the game that is being played. You bring in indentured servants from outside the country, you lay off American workers and, if you’re a corporation, you make a ton of money by under cutting the wages of American workers, replacing them with people who frankly shouldn’t be in the United States of America to begin with."
Vice President JD Vance breaks down the data: "If you are working as an H-1B visa in the United States of America, you’re earning $20,000 less than an American citizen hired in the same position. If you were brought in by one of these foreign outsourcing firms, you’re making $48,000 less than an American citizen in a similar position. So I’m sure that everybody here understands the game that is being played. You bring in indentured servants from outside the country, you lay off American workers and, if you’re a corporation, you make a ton of money by under cutting the wages of American workers, replacing them with people who frankly shouldn’t be in the United States of America to begin with."

“In the Trump administration, we’re cracking down on [H-1B abuse]; we’re saying this is against the law, and we are going to act.” – @AndreaLucasEEOC During her appearance on @VarneyCo, Chair Lucas highlighted the ways in which @USEEOC is advancing @POTUS’s commitment to put American workers first by cracking down on unlawful national origin discrimination, including H-1B abuse. The Chair’s message to employers is clear: no matter the justification – preferring an H-1B or any foreign worker over an American is unlawful and the EEOC will act to prevent discrimination and protect the American Worker.

Don’t blackpill. The @USEEOC is taking real action to protect American workers from anti-American discrimination. Two recent actions: 📍 PLANO, TEXAS — “ONLY H-1B.” The EEOC sued recruiting agency Sibitalent, alleging it refused to refer an American applicant for a California tech job. After he questioned the recruiter’s “ONLY H-1B” requirement, the recruiter stopped communicating with him. According to the lawsuit, Sibitalent then referred candidates of Indian and Nepali origin for the same position. 💵 NOVADOZ — $116,666 SETTLEMENT. The EEOC found reasonable cause to believe Novadoz allowed Indian employees to work remotely from India for personal reasons but denied an American employee’s disability-related request to work remotely within the United States. The resolution includes monetary relief, policy changes, training, and two years of reporting to the EEOC. Equal opportunity includes Americans. Employers and recruiters cannot use unjustified visa requirements as a proxy for national origin discrimination—or favor foreign workers because of their national origin. ▶️ Watch my video: xitter.cf/USEEOC/status/20994941… 📚 Know your rights. Read the EEOC’s educational materials on discrimination against American workers: eeoc.gov/discrimination-agai… If you believe you have experienced national origin discrimination, contact the EEOC promptly. Strict filing deadlines apply. Details on these enforcement actions: eeoc.gov/newsroom/eeoc-sues-… eeoc.gov/newsroom/novadoz-ph…
