$AVZ Minerals Limited (AVZ or Company) provides the following update to its shareholders.
Interim Arbitration Funding
AVZ has entered into a Funding Agreement with Mr Pei Zhenhua to advance up to US$ 5 million to AVZ, with the first tranche of US$ 2 million already received.
The funds are subject to agreed security arrangements and may be used for the purpose of costs incurred in prosecuting the arbitration proceedings before the International Centre for Settlement of Investment Disputes in Washington (ICSID) and the International Chamber of Commerce (ICC) Tribunals.
Settlement Discussions
AVZ's preferred outcome continues to be a negotiated resolution of the arbitration proceedings which involves the divestment of AVZ's interest in the Manono Project.
Any settlement must deliver a reasonable return to AVZ's shareholders and engagement with the various stakeholders is continuing but discussions are protracted due to the geopolitical complexity of the situation.
If a settlement cannot be achieved, AVZ, CATH, Mr Pei and DLA Piper are aligned in their commitment to prosecute the arbitration proceedings to their conclusion.
There have been no developments in the proceedings which have a material impact on AVZ's prospects of success in the proceedings, including by reason of the suspensions. The current status of the proceedings is summarised below.
Title Dispute (ICSID)
It will be recalled that AVZ, through its subsidiaries AVZ International Pty Ltd (AVZI) and Green Lithium Holdings Pte Ltd (GLH), together with Dathcom Mining SA (Dathcom), previously commenced arbitration proceedings (ICSID Case No. ARB/23/20) against the Government of the Democratic Republic of Congo (DRC) before ICSID in relation to the DRC’s failure to procure the grant of an exploitation permit (PE) to Dathcom in respect of the land the subject of PR 13359.
AVZ previously obtained a suspension of the ICSID proceedings to facilitate settlement discussions and reduce expenditure.
The suspension has been lifted and the arbitration proceedings are now progressing with the DRC pursuing an amended application for security for costs whilst AVZ is pursuing a new application for provisional measures to preserve the status quo.
The Tribunal and the Parties have not yet finalised a new procedural timetable for the merits.
Dathcom JV Dispute (ICC)
It will be recalled that AVZ, through its subsidiary AVZI, is party to two arbitration proceedings before the ICC, one was brought against La Congolaise d’Exploitation Minière (Cominière), and one which was brought against AVZ by Cominière, Jin Cheng Mining Company (Jin Cheng), a subsidiary of Zijin Mining Limited (Zijin), in relation to alleged breaches of the shareholders’ obligations under the Dathcom joint venture agreement dated 27 January 2017 as amended (Dathcom JVA), and the purported termination of the Dathcom JVA by Cominière which resulted in the transfer of PR 13359 to Cominière and the application to wind-up Dathcom by Dathomir Mining Resources SARLU (Dathomir).
AVZ previously obtained a suspension of the ICC case in which it is the claimant, to facilitate settlement discussions and reduce expenditure. The ICC Tribunal has now lifted the suspension and the arbitration proceedings are progressing. Cominière is pursuing an amended application for security for costs.
The parties submissions on the merits will follow between October 2026 and April 2027, with a hearing scheduled to be held on 24-28 May 2027.
Dathomir Dispute (ICC)
It will be recalled that AVZ, through its subsidiary AVZI, previously commenced two ICC arbitration proceedings against Dathomir in relation to Dathomir’s attempts to challenge the sale to AVZI of its 15% shareholding in Dathcom.
It will also be recalled that AVZ was successful in the first ICC proceedings which confirmed that upon exercise of the option, AVZI acquired 10% of the shares in Dathcom pursuant to the 2020 share purchase agreement.

Au cours des six dernières années, @Cominière #RDC n'a pas tenu ses promesses en matière d'infrastructures et de développement minier. Le projet #Zijin Manono @Manonolithium en est un exemple flagrant : malgré des engagements initiaux concernant la mise en place d'une unité de traitement de l'hydroxyde, les opérations actuelles se limitent strictement à l'extraction et à l'exportation de lithium brut.
Si la République démocratique du Congo avait maintenu son partenariat avec $AVZ Minerals, une unité de traitement entièrement localisée serait déjà en place. Afin de préserver le climat des investissements dans le pays, le gouvernement de la RDC – et plus particulièrement les ministères des Mines @MinMinesRDC , de la Justice @JusticeGouvCD et du Portefeuille – doit exiger des comptes de toute urgence de la direction de Cominière, notamment de @LisetteKabanga Lisette Kabanga, de @CelestinKibeya Célestin Kibeya et de l'ancien et @adelekayinda01 et directeur général de la #CAMI, Jean-Félix Mupande Kapwa @JFMK Des mesures correctives immédiates s'imposent, à commencer par la signature d'un protocole d'accord et l'obtention d'un permis d'exploitation minière valide pour réintégrer AVZ.

Cette phrase change tout.
L'économie, dans le fond, c'est juste un problème d'allocation. Tu as des ressources finies et des usages infinis. Qui décide où va quoi ?
Imagine une cour de récré. 100 enfants, des paquets de cartes Pokémon distribués au hasard. Tu laisses faire. Très vite, un ordre émerge. Les bons joueurs accumulent les cartes rares, les collectionneurs trient, les négociateurs trouvent des deals. Personne n'a planifié. Et pourtant chaque carte finit dans les mains de celui qui en tire le plus de valeur. Le système maximise le bonheur total de la cour. C'est ça, la main invisible.
Maintenant fais entrer la maîtresse. Elle trouve ça injuste. Léo a 50 cartes, Tom en a 3. Elle confisque, redistribue, impose l'égalité. Trois effets immédiats. Les bons joueurs arrêtent de jouer, à quoi bon. Les mauvais n'ont plus de raison de progresser, ils auront leur part. Les échanges s'effondrent. La cour est égale, et morte. Elle a maximisé l'égalité, elle a détruit le bonheur.
Le problème de la maîtresse, c'est qu'elle ne peut pas avoir l'information que la cour avait collectivement. C'est le problème du calcul économique de Mises, formulé en 1920. L'URSS a essayé de le résoudre pendant 70 ans avec le Gosplan. Résultat : pénuries, queues, effondrement. Pas parce que les Soviétiques étaient bêtes, parce que le problème est mathématiquement insoluble en mode centralisé.
Quand Musk a 200 milliards, il ne les consomme pas, il les alloue. SpaceX, Starlink, Neuralink, xAI. Chaque dollar est un pari sur le futur. Et lui a un track record. PayPal, Tesla, SpaceX. Il a démontré qu'il sait identifier des problèmes immenses et y allouer des ressources avec un rendement spectaculaire.
L'État aussi a un track record. Hôpitaux qui s'effondrent, éducation qui décline, dette qui explose, services publics qui se dégradent malgré des budgets en hausse constante. Le marché identifie les bons allocateurs, la politique identifie les bons communicants.
Le profit n'est pas une finalité, c'est un signal. Il dit : tu as alloué des ressources rares vers un usage que les gens valorisent suffisamment pour payer. Plus le profit est gros, plus la création de valeur est grande. Quand Starlink est rentable, ça veut dire que des millions de gens dans des zones rurales ont enfin internet. Quand un ministère est en déficit, ça veut dire qu'il consomme plus qu'il ne produit. L'un crée, l'autre détruit, et on appelle ça redistribution.
Dans nos sociétés il y a deux catégories d'acteurs. Les entrepreneurs et les bureaucrates. L'entrepreneur prend un risque personnel pour identifier un problème, mobiliser des ressources, créer une solution. S'il se trompe il perd. S'il a raison, ses clients gagnent, ses employés gagnent, ses fournisseurs gagnent, l'État collecte des impôts. Il est la cellule de base du progrès humain.
Le bureaucrate ne prend aucun risque personnel. Son salaire est garanti. Au mieux il maintient une rente existante. Au pire il la détruit par excès de réglementation, mauvaise allocation forcée, incitations perverses qui découragent ceux qui produisent. Mais dans aucun cas il ne crée.
Regarde les 50 dernières années. iPhone, internet civil, SpaceX, Tesla, Google, Amazon, Stripe, mRNA, ChatGPT. Toutes des inventions privées, portées par des entrepreneurs, financées par du capital risque. Pas un seul ministère n'a inventé quoi que ce soit qui ait changé ta vie au quotidien.
La France est devenue le laboratoire mondial de la dérive bureaucratique. 57% du PIB en dépenses publiques, record absolu. Une administration tentaculaire, une fiscalité qui pénalise la création de richesse. Résultat : décrochage face aux États-Unis, à l'Allemagne, à la Suisse. Fuite des cerveaux. Désindustrialisation. Dette qui explose.
Et le pire c'est que la mauvaise allocation s'auto-renforce. Plus l'État prélève, moins les entrepreneurs créent. Moins ils créent, moins il y a de base fiscale. Plus l'État s'endette et taxe. Boucle de rétroaction négative parfaite. La maîtresse pense qu'elle aide, et chaque année la cour produit moins.
Dans nos sociétés, ce sont les entrepreneurs, toujours, qui font avancer la civilisation. Les bureaucrates au mieux maintiennent une rente, au pire la détruisent. Aucune société n'a jamais progressé en taxant ses créateurs pour subventionner ses gestionnaires.
La question n'est jamais qui a combien. C'est qui alloue le mieux la prochaine unité de ressource pour maximiser le futur de l'humanité. La réponse depuis 200 ans n'a jamais changé. Ce ne sont pas les fonctionnaires.

@ICC_arbitration a déjà conclu qu'il n'y avait pas eu de falsification de la part de $AVZ. Par conséquent, ce jugement rendu par un tribunal corrompu n'a aucune valeur et peut être rejeté. @ICC_arbitration est compétent en vertu du contrat de coentreprise.

‼️ You are all aware that AVZ and the Congolese state are in court at the moment, but we were surprised that the leaders of Cominière @cominiereSA @CelestinKibeya @LisetteKabanga , our Congolese mining company, signed an agreement with the Chinese company #Zijin Mining for an amount that varies, sometimes 33 million, sometimes 70 million
But what has made us angry for the moment, what allows us to bring you here, dear gentlemen and ladies of the press, is rather the progress of the contract. The AVZ case: Manono, one of the world's largest lithium deposits. AVZ (Australian) initially held the rights → revoked in 2023 by the Ministry of Mines (alleged delays). Rights reassigned to Zijin (China) + Cominière (state-owned).
Result: Ongoing arbitration at ICC/ICSID. AVZ has already won a key step (partial award of ~€39.1 million + interest against Cominière for non-compliance with emergency orders, as ruled in March 2025). However, the project remains paralyzed for years.

An die junge Menschen die unter 30 sind und die nun vermehrt die Linke = SED wählen, die Jung Kommunisten und Jung Marxisten.
Thema heute: Wohnungen und Mieten im real existierendem Sozialismus
Wenn ihr glaubt, dass der von der Linken propagierte „ Demokratische Sozialismus“ sozial ist und eure Probleme der Gegenwart, wie zum Beispiel die hohen Mieten löst, nun da muss ich Euch als Zeitzeuge der DDR enttäuschen.
Schaut Euch doch einfach das Programm der Linken einmal genauer an. Wo soll der Unterschied zwischen Sozialismus wie er in der DDR existiert hat und dem „neuen“ Sozialismus der Linken liegen? Ich sehe keinen! Wie gehabt möchte man Reichtum enteignen, eine sozialistische Vergesellschaftung, sprich Gleichschaltung erreichen, Unternehmen verstaatlichen, die Soziale Marktwirtschaft wird abgelehnt und zur Überwindung des Kapitalismus wird aufgerufen. Der übliche sozialistische Schwachsinn also, den wir aus DDR Zeiten bestens kennen.
Was bitte soll daran Neu und vor allem Demokratisch sein?
Lasst Euch doch nicht verarschen. Und um nun mal ein konkretes Beispiel zu benennen. Im Sozialismus gab es keinen freien Wohnungsmarkt, keine Anzeigen, einfach nichts. Wenn du eine Wohnung haben wolltest, dann musstest du dich im Amt für Wohnungswesen - Gebäudewirtschaft dafür „bewerben“. Als junger Mensch der noch bei den Eltern wohnte, konntest du dir den Gang dorthin gleich sparen. KEINEN ANSPRUCH!
Bevorzugt auf die Wartelisten kamen junge Ehepaare mit Kindern. Da dies bekannt war, heirateten viele junge Menschen bereits mit 19 Jahren und dann kam mit 20 auch schon des erste Kind, kurz darauf das zweite Kind. Und dann bekam man eine Wohnung? Weit gefehlt, denn man war dann zwar auf der Warteliste beim Amt, aber eben ganz unten. Und so haben Hunderttausende junge Familien in der DDR weiterhin zusammen mit ihren Eltern gewohnt. Oft Jahre lang, natürlich sehr beengt und teilweise unter unglaublichen Bedingungen.
Und wenn dann der lange ersehnte Brief vom Amt kam, war die Enttäuschung oft sehr groß, denn in der Regel bekam man eine sogenannte Altbauwohnung zugewiesen. Bruchbuden, wie auf dem Foto abgebildet, mit Kohlenheizung, keinem warmen Wasser, Elektroleitungen aus vor Kriegszeiten und dem Plumpsklo eine Etage tiefer, draußen im Treppenhaus. Wahlweise gab es fließend Wasser von den Wänden, oder von der Decke und in den Wänden soviel Salpeter, dass keine Tapete der Welt daran hielt. Die Wohnung hatte man dann zu nehmen, etwas anderes gab es nicht. Oder man verzichtete und landete auf der Warteliste wieder ganz unten. Und in diesen Bruchbuden lebte die absolute Mehrheit der DDR Bürger.
Eine schöne, helle Platten Neubauwohnung? Pustekuchen, dass war nur ein feuchter Traum. Die gab es in der Regel, wenn es sie vor Ort denn überhaupt gab, nur für verdiente Genossen oder die „Schlitzohren“ mit Beziehungen, auch Vitamin B genannt.
Und ja, diese Altbauwohnungen waren spottbillig und kosteten nur ein paar Mark im Monat. Billig, da die Preise gedeckelt waren. Da war sie, Eure Mietpreisbremse. Mit den unglaublich niedrigen Mieten konnte aber nichts renoviert, ja nicht mal instand gehalten werden und so nahm der Verfall der Bruchbuden immer weiter zu. Wenn ihr das unbedingt wieder haben wollt, na dann wählt halt die Linke. Aber heult hinterher nicht herum, von wegen und „Das haben wir aber alles nicht gewusst und so auch nicht gewollt“.
So sieht die Realität im Sozialismus aus. Macht Euch da nichts vor. Die Linke wird nichts zum Guten für Euch wenden. Gar nichts. 🤔
