இந்திய அரசியலமைப்புச் சட்டத்தின் உறுப்பு 21 (Article 21) பின்வருமாறு கூறுகிறது:
"சட்டத்தினால் நிலைநிறுத்தப்பட்ட நடைமுறையின்படியன்றி, எந்தவொரு நபரின் உயிரோ அல்லது தனிநபர் சுதந்திரமோ பறிக்கப்படக் கூடாது."
உறுப்பு 21 தனிநபர்களைக் கட்டாய அல்லது வற்புறுத்தப்பட்ட தடுப்பூசியிலிருந்து (forcible or mandatory vaccination) பாதுகாக்கிறது.
குறிப்பு (கூடுதல் தகவல்): இந்திய உச்ச நீதிமன்றம் 'ஜேக்கப் புலியேல் எதிர் இந்திய ஒன்றியம்' (Jacob Puliyel v. Union of India) வழக்கில், உறுப்பு 21-ன் கீழ் வழங்கும் உடல் தன்னாட்சி உரிமையின் (Right to bodily autonomy) அடிப்படையில் எவரையும் கட்டாயப்படுத்தி தடுப்பூசி போட முடியாது என்று தீர்ப்பளித்துள்ளது
