In 2013, the fairness for high skilled Immigrants act was introduced in parallel with CIR. Why can't it be done now? @RepZoeLofgren plz introduced the Durbin-Lee agreement. If #USCAct2021 passes, then all is well and good. If not, we march ahead with our bill.

In 2023, the Biden administration was asked by a bipartisan group of Congresspersons to change the “dates for filing” date on the October 2023 visa bulletin to “current” so that the high skilled workers of America could change jobs and be shielded from deportation that might come from a future administration. The tech companies went to the White House and strongly opposed this proposal. Had this proposal been enacted, there would have been no basis for this DOL investigation because no one would have been on H-1B visas anymore.
"What was presented as Microsoft replacing 6,000 people who lost their jobs with 9,000 foreigners was, frankly, completely off-base."
Brad Smith, Vice Chair and President of Microsoft, gave his response to @BrendanBordelon about the Trump administration's claim that Microsoft was engaged in fraud when it applied for permanent residency for foreign workers.

Two things keep coming up on this platform wrt Indian immigration to the US:
(1) All the H1B visas go to Indians
(2) Indians don't assimilate
Reality check:
(1) H1B visas are dual intent. Folks from most other nations use H1B visas for a short period, and transition to permanent green card, and eventually citizenship. Indians, on the other hand, have to keep using and renewing their H1B visas because regardless of skills, education, income, they are subject to per-country caps in the green card process. Data shows the share of the new/initial H1B visas "going to Indians" is actually on the decline. Latest FY2025 data puts it at ~50%. Expect FY2026 to dip further with the wage level based lottery, and the potential $103k (or equivalent) fee in the works, as that would primarily impact the body shops/3rd party contracting firms (as it should).
(2) It follows from the above, that there are people who actively want to make the United States their permanent home, work legally, buy homes, raise families here, become permanent residents and eventually citizens, yet spend 10, 15, 20+ years in temporary status despite following the legal process. So perhaps a better question is: What does decades of legal limbo do to assimilation and a sense of belonging? How fully can someone feel that they belong when they have done everything the system asked of them, yet permanent membership in that society remains indefinitely out of reach?
P.S. None of this is an argument for tolerating fraud, abuse, fake jobs or misuse of the H1B program. Those should be addressed on their merits. It is an argument for distinguishing abuse from people who are following the legal process exactly as written.

Race-baiters and hate YouTubers love screaming about “too many Indians on visas”
What they never explain is why so many Indians are STILL on H-1Bs:
They followed the law.
Built careers.
Paid taxes.
Raised families.
And then got trapped for decades in a government created GREEN CARD BACKLOG.
Their careers are restricted. Their families live with uncertainty. Their children can age out.
Congress needs to fix this before it’s too late.
For many families, it already is.

i think i have figured out the trick for these things. look at the image. close your eyes. imagine it changing direction and then open your eyes. basically, you get a faint image when you close your eyes. imagine reversing it and then open your eyes.

Five H-1B rules.
Zero visas removed.
Three already law.
Each one makes the visa holder at the next desk less able to quit , which is the only reason your salary is what it is.
Handicapping him doesn't hire you. It reduces your bargaining power.

People like @SanDiegoKnight will post Q3 H1B LCA snapshot as ragebait without telling you the full story.
Here’s what they leave out:
- Q3 is always the peak filing quarter because of the H-1B cap cycle
- Also, FY26 Q1–Q3 applications are down 8.8% vs FY25, consistent with a softer hiring market
- And ofcourse, LCA covers multiple positions, as well as renewals & extensions, so application counts alone do not equal actual workers
Sad that @RonDeSantis reposts such accounts/posts
🚨 New Department of Labor data just dropped.
Through FY2026 Q3, employers received certification for 830,710 foreign-worker positions under the H-1B/H-1B1/E-3 LCA program.
And look where they’re going:
• 241,846 Software Developers
• 62,170 Electronics Engineers
• 30,973 Data Scientists
• 28,058 IT Project Managers
• 24,743 Software QA Analysts & Testers
Software developers alone account for 29.1% of every certified position.
Top employers?
Cognizant: 79,121
Qualcomm: 71,203
Amazon: 45,025
Meanwhile, American tech workers keep being told there aren’t enough jobs.
At what point do we stop calling this a “skills shortage” and start asking why hundreds of thousands of foreign-worker positions are being certified while Americans are looking for work?

if you talk about h1b slaves and don't talk about country caps in greencard that enable that servitude, then you are the problem

Indians are highly selected yes, but also shackled by per-country caps in the skilled immigration pathway and forced to wait 10-15 years before they can truly have the freedom to pursue entrepreneurship.
Rather than a total immigrant population (which includes temporary visas, student visas and even undocumented), a reasonable estimate would be to look at the principal workers in the employment green card category (almost half of employment green cards go to spouses & kids, especially for those from backlogged countries)
The numbers then make a lot more sense.
India moves into the top tier when you use a denominator closer to people who could actually found companies.

Impact of discriminatory per-country caps
Same education/skills
Same eligibility requirements
Same immigration category
Same agencies doing the vetting
Born in India: petition approved 13 YEARS AGO --> greencard on hold
Born elsewhere: petition approved YESTERDAY --> greencard on fast track

PERM is not a "hiring process." It's a theoretical "test of the labor market." If an employer doesn't do a bona fide test of the labor market, the PERM application should be denied by the Labor Dept. It has nothing to do with hiring discrimination at all.

the answer is rather simple.
"hey this tech is super cool, look at what i can do!" - agreed. it is pure magic that as i write this twitter post, my 100% vibe coded app continues to get features. Thats fun.
"hey, you better be producing thousands of lines of code a day and this is the only normal that will be accepted in the future" - this is a completely different message.
i think most peoples problem with gary is that he frames things in such crappy terms. I would be completely down to celebrate the Ws if it was the former, but it is instead the latter. And i am tired boss. I am tired of getting hacked on every website and having every website run like shit.

How the tables have turned.
The same immigrant "students" who worked in cahoots with anti-immigrants & often outright racists to spread all sorts of lies & misinformation about a bill to remove national origin discrimination, are currently faced with the same discrimination.
That country of birth is an immutable characteristic, will hopefully not be lost on them now.

Your home is where your life is.
Your job.
Your spouse.
Your child's school.
Your mortgage.
Your decade of tax returns.
India is where you were born. America is where you live.
These people flew to India for two weeks — a parent's funeral, a wedding, a medical emergency. They had valid H-1B visas and confirmed appointments.
Then the State Department cancelled thousands of interviews overnight. No new regular slots in 100+ days. Rescheduled into 2027.
Their kids are in American schools. Their rent is due. Their managers are asking when they're coming back. And the answer is: nobody knows.
When the government traps you 8,000 miles from your family and livelihood with no timeline and no recourse , yes, you are stranded.
The country you're standing in doesn't change that.

100+ days.
That's how long it's been since a single regular H-1B appointment slot was released in India.
All 5 consulates — ZERO availability.
Earliest dates pushed to 2027.
Thousands stranded.
Families torn apart.
Careers destroyed.
They followed every rule. Filed every form. Paid every fee.
And the system is punishing them for visiting their parents.
@StateDept @USCIS , Stop using Indian immigrants as your tool for political propoganda.
