⚖️ A ruling that the Tate brothers are extraditable in November does NOT mean they’ll be immediately sent to the UK. There are still several legal steps ahead. The habeas corpus they’ve already filed focuses on their detention and their request for release. It does not automatically challenge a future extradition certification. If the judge certifies them as extraditable, their lawyers would challenge that decision through habeas corpus. They may need to file a new petition or seek to amend the existing one, depending on the court’s decision. If that challenge fails, an appeal may be possible. Only after the judicial process is exhausted does the final surrender decision go to Secretary of State Marco Rubio. The point is, there are several stages between the November hearing and any actual surrender. The case has been moving quickly, but a ruling that they’re extraditable is not the same as being handed over to the UK. ⚖️ ⭐️THE TATES FACE A DIFFICULT CHOICE: MORE TIME TO PREPARE — OR MORE TIME IN CUSTODY? The August 27 bail hearing transcript raises a serious fairness concern about the practical consequences of the UK extradition process. On page 55, the Tates’ UK solicitor explains that the brothers do not yet know the identities of the people involved and that the preparation period may be limited to approximately 181 or 182 days. The solicitor questions whether that period would be sufficient to investigate the allegations, obtain relevant evidence and become fully prepared for trial. The central issue is the relationship between preparation time and continued detention. The brothers may need additional time to prepare their defense, but any extension or delay could also result in them remaining in custody for longer. Conversely, if additional time is not granted, they may be required to proceed without a meaningful opportunity to identify the allegations, examine the evidence or prepare their case properly. This places them in a difficult position: accept a potentially inadequate preparation period or request more time while facing the possibility of continued detention. The transcript does not establish that an abuse of process has occurred. It does, however, demonstrate why the relationship between the preparation timetable, procedural delays and continued custody deserves careful examination. Whether this concern would be legally decisive would depend on the applicable extradition rules, the reasons for any delay, the court’s assessment of the evidence and the safeguards available to protect both the defendants’ rights and the integrity of the proceedings. No person should be required to defend themselves without a reasonable opportunity to understand the allegations, investigate the evidence and prepare for trial.
