BREAKING: MAJOR DEVELOPMENT IN THE 9/11 CASE AND HERE’S WHO IS PAYING FOR THE DEFENSE
Nearly 25 years after September 11, 2001, Khalid Sheikh Mohammed the man the United States accuses of being the principal architect of the 9/11 attacks still has not gone to trial.
Now another major evidentiary fight is affecting the prosecution. The 9/11 case has been bogged down for years over whether statements obtained following CIA detention and coercive interrogation can legally be admitted. These disputes are important because evidence can be excluded if a court determines a confession was not voluntary.
Meanwhile, a military judge has now scheduled Mohammed and three co-defendants to begin trial on June 5, 2028 at Guantánamo Bay, nearly 27 years after the attacks. Prosecutors had sought a January 2027 trial, but the judge determined additional time was necessary to resolve the enormous number of outstanding pretrial issues.
So who is defending Khalid Sheikh Mohammed and who pays for it?
First, KSM was NOT a member of the United States military. He is being prosecuted through the U.S. military-commission system, which is why military attorneys and the Department of Defense are involved.
The Military Commissions Defense Organization operates separately from the prosecution and provides defense representation to people being tried by military commission. The Department of Defense states that these defense teams can include military attorneys and civilian attorneys employed by DOD. Because this is a death-penalty case, the accused is also appointed a specialized capital attorney known as “learned counsel.” DOD specifically states that the fees and expenses of appointed learned counsel are paid by the Department of Defense.
KSM’s defense has included longtime attorneys Gary D. Sowards and other military/civilian defense lawyers. Official military-commission records identify Sowards among the attorneys representing Mohammed.
Why does someone accused of orchestrating 9/11 get an American-funded defense?
Because Congress wrote that protection into the Military Commissions Act. Under 10 U.S.C. §§ 948k and 949c, military defense counsel must be detailed to people prosecuted in these commissions. The government’s own comparison of the legal systems explicitly describes military-commission defense counsel as being provided “at no cost” to the accused, regardless of ability to pay.
An accused can also retain a qualifying private civilian attorney, but that attorney is retained at the accused’s expense. That does not eliminate the military counsel provided through the commission system.
And this is an important point: providing KSM a defense isn’t the government siding with him. The same United States government is prosecuting him and seeking to prove charges that can result in the death penalty. Providing qualified defense counsel is part of the legal process Congress created so that a conviction and sentence can withstand subsequent appeals.
What should infuriate Americans isn’t simply that he has lawyers. It’s that nearly a quarter-century after 2,976 victims named in the 9/11 charge sheet were killed, the case remains consumed by pretrial litigation and the actual trial isn’t currently scheduled to begin until 2028.

Prosecutors say an armed Marine vet caught at Trump’s California golf club had 208 pages on Secret Service agents and Melania’s schedule.
Jeanine John Taele, 38, of Downey, California, was spotted July 31 at Trump National Golf Club Los Angeles in Rancho Palos Verdes while agents prepped for the president’s August 4 visit.
He wore an earpiece, walked the course, and filmed security work. He came back.
Deputies arrested him after finding hollow-point ammo on him and a loaded 9mm pistol in his truck, plus binoculars and a “security protection agent” badge.
A search of his home turned up an unregistered short-barreled rifle, a .45 pistol, body armor, high-capacity magazines, radio gear, and notebooks.
In court Wednesday, prosecutors said those books ran 208 pages. They listed Secret Service schedules, notes on individual agents, course sketches, copies of First Lady Melania Trump’s daily schedule, and research on “going off the grid.”
He told agents he worked for the State Department. A psych evaluation found him unfit for trial. He falsely claimed 14 years at State.
Judge John Lonergan sent him to mental-health court and revoked bail. Federal charge: possession of an unregistered short-barreled rifle.
State charges include a concealed g*n and a large-capacity magazine. He also had an El Segundo robbery warrant.
Taele served as a Marine corporal from 2008 to 2016, including Iraq and Afghanistan.
That service does not explain how a private citizen gets Melania’s schedule and agent-by-agent logs. After two prior attempts on the president’s life, Secret Service and the FBI should treat every page as a leak hunt.
