In January 2025, we sent a letter to @SenBlackburn outlining concerns with the Senate version of VACRA. Yesterday, @RepBenCline introduced a companion bill in the House, and our concerns still stand. VACRA risks:
⢠High financial and administrative costs
⢠Disrupting the Copyright Officeās ongoing IT modernization with heavy technical and administrative burdens

So, you may have heard of this hot new platform called...Substack? We may be a little late to the party, but we're coming out swinging with thoughts on how maybe the boring-est part of the '76 Copyright Act is maybe having some big consequences in the AI age.
50 years ago today, the Copyright Act of 1976 was signed, officially writing #FairUse into statutory law! šāļø
While signed into law for half a century, fair use has long been the engine behind remix culture, documentary filmmaking, search engines, and the digital economy. Letās celebrate 50 years of balanced copyright that protects both creators and innovators!
As a recent DOJ filing in NYT v. OpenAI states: forced licensing fees āwould disproportionately benefit legacy media.ā
A new blog by Re:Create member @RSI highlights how fair use is crucial to ensure local news journalists can access and afford vital AI tools: rstreet.org/commentary/localā¦
Journalists have used web scraping for 20+ years to expose corruption, track lobbyist influence, and reveal discrimination.
Broad crawler bans such as the Stealth Bot Prohibition Act risk cutting off the exact tools newsrooms use to hold power accountable.

The Ninth Circuitās Doe v. GitHub ruling provides important clarity for #AI coding tools, adopting CCIAās position that the DMCAās #copyright rules shouldnāt become a broad new liability regime. Code that resembles existing code, without more, isnāt enough to establish that copyright information was unlawfully removed. That clarity matters for AI developers. Read more: buff.ly/fdjvIif

This cringe was posted by the lady who likes to joke that āfair use is a fairly useful way to steal my creation,ā and whose NO FAKES bill would chill ordinary people from using AI to make actually good videos. And yet here she is, using other peopleās music and choreography to make a lame ad.
šØ TODAY: Re:Create sent letters to the House Energy & Commerce and Senate Commerce Committees warning against the Stealth Bot Prohibition Act. While framed as a fix for bad bots, this bill's vague language threatens journalists, researchers, and civil liberties groups using anonymous data gathering or AI tools to investigate bias and disinformation.

Over a decade ago, internet users overwhelmingly rejected the dangerous site-blocking schemes of SOPA/PIPA. Now, Congress is trying again with the American Copyright Protection Act. We cannot let unbalanced copyright enforcement break the open internet. Read @EFF's full blog here: eff.org/deeplinks/2026/10/coā¦
Re:Create Executive Director @BC_Butler on the Third Circuit's Ross opinion: āPlenty of fair uses compete with the works they use.ā
Competition is not the same as substitution, and the court conflated the two.

ICYMI: Last month in @dcexaminer, @BC_Butler showed how easily DMCA takedowns can be abused, including to pull negative news coverage in the middle of an active campaign: washingtonexaminer.com/op-edā¦
Now Big Content is asking Congress to expand blocking powers. Re:Create opposes all site-blocking proposals, including the ACPA and the Defend IP Act.
Re:Create Coalition retweeted
The Ninth Circuit adopted CCIA and Chamber of Progressā (@ProgressChamber) position in Doe v. GitHub, rejecting an expansive interpretation of the DMCAās copyright management information provision. The ruling clarifies that AI-generated code resembling existing source code does not, by itself, establish a DMCA violation simply because it lacks the original codeās attribution or licensing information. 1/2
