Writing for the majority, Barrett stated: “Justice Jackson, however, adopts a surprising line of critique that lacks grounding in established sources or recognized doctrine. Characterizing concerns about judicial authority as ‘mind-numbingly technical,’ she proposes a conception of the judicial function that would challenge even the strongest proponents of judicial supremacy.” Barrett continued: “We will not elaborate on Justice Jackson’s position, which conflicts with more than two centuries of precedent and the Constitution itself.
