Check out my recent publication, The Good Samaritan Myth: scholar.smu.edu/smulr/vol79/… in the @SMULawReview: For 50 years, U.S. food waste law has asked corporations to act like Good Samaritans. Read why this strategy has failed and what should replace it.
7/ The article is free to download. If you work on food, hunger, climate, or corporate accountability, I’d be grateful if you’d read it and share: scholar.smu.edu/smulr/vol79/…
6/ I propose a Corporate Partner Food Waste Act: stronger recovery duties near food-insecure communities, penalties scaled to revenue, and real EPA monitoring. Results over good intentions.
5/ France took the opposite route and mandated supermarket donations. Donations soared, but food insecurity barely moved: the rules were rigid and no one tracked whether food reached people in need.
4/ The policy even misreads its own parable. Corporations aren’t the Samaritan, who helped out of compassion. They’re the innkeeper, who helped because he was promised payment.
3/ Even the best performer fell short. Kroger, ranked #1 among U.S. supermarkets for its food waste commitment, cut waste by less than 4% after nine years, against a 50% goal.
2/ The results: food waste grew from 30% of the food supply in 1974 to nearly 40% today. 47.4M Americans face food insecurity. Landfilled food produces about a third of human-related methane emissions.
1/ For 50 years, U.S. food waste law has rested on one assumption: give corporations tax breaks and liability protection, and they’ll donate surplus food like Good Samaritans.
My new article in the SMU Law Review argues that assumption is a myth. 🧵

I was quoted in @USATODAY on SNAP food restrictions rolling out across 22 states.
For 60 years, USDA denied these exact requests. Nothing in the law changed, only the administration.

"Keep hope alive" was never naive optimism. It was a command. A moral imperative. A refusal to let despair be the final word.
We need that same fire today.
