UNAMA expresses concern over #Afghanistan de facto authority arrests of women and girls.
Statement: unama.unmissions.org/en/pres…
Accountability Watch Afghanistan welcomes the @IntlCrimCourt’s arrest warrants against Taliban officials: Haibatullah Akhundzada, Abdul Hakim Haqqani, Habibullah Agha and Neda Mohammad Nadim.
This marks a significant development in efforts to establish individual criminal responsibility for the Taliban’s systematic persecution of women and girls and those perceived to oppose or resist its policies.
#States must take all necessary measures to facilitate their arrest and surrender to the Court.
AWA urges the international community to ensure that these warrants do not remain decisions on paper. States must fully cooperate with the ICC and must not allow Taliban to escape justice and accountability through diplomatic engagement, travel exemptions or political considerations.

We extend our gratitude to @EU_UNGeneva as penholder of Afghanistan’s resolution at #HRC63, for their role and leadership in preparing and passing a comprehensive resolution on Afghanistan.
Thank you for supporting Afghanistan’s civil society and for echoing women’s and minorities’ voices in the @UN_HRC debates and discussions on Afghanistan. #Afghanistan #Accountability
Today #HRC63 unanimously adopted a resolution led by the EU, on the situation in 🇦🇫. The resolution, adopted with wide cross-regional support, renews the mandate of the Special Rapporteur & ensures continued close attention to the abysmal human rights situation on the ground.

An important outcome well reflecting the civil society advocacy at the HRC63. Glad that two of AWA’s key recommendations are included in the resolution! #womenrights #minorities #IIMA #Afghanistan

Afghanistan: Amnesty International welcomes the adoption of the latest resolution on Afghanistan at #hrc63 by @UN_HRC. Amnesty International looks forward to the much-needed study mandated by the resolution on national or ethnic, religious, and linguistic minorities, as well as to the Council's decision to continue focused discussions on the rights and circumstances of women and girls in the context of the Taliban's ongoing systematic and widespread human rights violations and abuses. The Taliban must be held to account and compelled to end their abusive rules, practices, and policies.

We welcome the United Nations Human Rights Council's resolution A/HRC/63/L.8 on the situation of human rights Afghanistan. The resolution mandated the UN Special Rapporteur @SR_Afghanistan to conduct a study on the situation of persons belonging to national or ethnic, religious and linguistic minorities in Afghanistan, and to present that report, in combination with an oral update, to the 82th session of the General Assembly.
Ahead of the resolution, Accountability Watch Afghanistan submitted inputs independently and advocated as part of civil society call urging the HRC to mandate the SR to conduct a thematic report on the situation of minorities in Afghanistan alongside his continued reporting on the situation of women and girls.
The #Resolution adopted today strongly echoes the recommendations of the civil society and it includes the #following:
1. Welcomes the update by the Office of the High Commissioner on the advancement of the operationalization of the independent investigative mechanism and the deployment of the start-up team;
2. Requests the Secretary-General to appoint the staff of the mechanism as expeditiously as possible, taking into account the experience of other relevant mechanisms, and to recruit or allocate impartial and experienced staff with relevant skills and expertise, drawing upon the terms of reference prepared by the United Nations High Commissioner for Human Rights;
3. The UNSR to present a report to the Human Rights Council at its sixty-sixth session, together with a study on the human rights situation of persons belonging to national or ethnic, religious and linguistic minorities in Afghanistan, and to present that report, in combination with an oral update, to the General Assembly;
4. The UNSR to present to the Human Rights Council at its sixty-fifth session an oral update on the situation of women and girls in Afghanistan, adopting an intersectional approach, to be followed by an enhanced interactive dialogue;
5. The Secretary-General to allocate the resources necessary for the implementation of the present resolution, including the logistical and technical resources necessary to support the functioning of the mechanism, including in terms of staffing, location and operational freedom to deliver on its mandate and bearing in mind the need to ensure consistency across such mechanisms;
6. The OHCHR to present, jointly with the IIMA annual reporting, at the HRC 64 session, a report focusing on the impact of the Taliban’s dismantling & replacement of the legal & judicial framework of Afghanistan, with particular attention to access to justice & effective remedies, including an assessment of the impact of changes to the legal, judicial & institutional framework on the enjoyment of human rights.

Pakistan has failed to exercise due diligence in conducting cross-border strikes against the TTP hideouts in Afghanistan, even if the Taliban are responsible for the group's presence. This has led to harm to civilians and civilian properties.
Accountability Watch Afghanistan calls for the protection of civilians in the ongoing tension between the Taliban and Pakistan. The Taliban's responsibility to prevent anti-Pakistan militants operating from Afghanistan's territory does not exempt Pakistan from its international law obligations in the conduct of military operations.

"Civil society should not wait for the UN alone. The people’s tribunals and domestic accountability avenues may also play an important role," said the UN Special Rapporteur on the situation of human rights in Afghanistan during the discussion at the UN HRC.
The Special Rapporteur concluded that "the Human Rights Council could and should do more." He noted that language on Hazaras in the previous year’s resolution should be reviewed and strengthened. Read more here: awa-af.org/publications/hrc6…

What should the @UNHumanRights Council's upcoming resolution on #Afghanistan include? As part of our advocacy mission at the UN-Geneva during the HRC63, we advocated for the advancement of the Council's mandates on Afghanistan, particularly highlighting the gaps in reporting on grave human rights violations in Afghanistan. During the #HRC63, we joined over 90 civil society organizations calling on the @UNHumanRights Council to strengthen it's existing mandates on Afghanistan and further cooperate with other accountability avenues including with the International Criminal Court (@IntlCrimCourt). "While the Taliban appear to openly justify discriminatory treatment of women through religious texts, they often deny discrimination against ethnic and religious minorities, framing such concerns as attempts to sow discord." "Richard Bennett, @SR_Afghanistan, welcomed the event as timely and well-structured, including survivor testimony, contemporary updates, and legal analysis. He noted that although the IIMA [International Investigative Mechanism for Afghanistan] was not yet fully operational, the discussion was not too early for the International Criminal Court (ICC), other accountability mechanisms, or his own mandate.
The Special Rapporteur acknowledged that his mandate includes monitoring, reporting, documenting and preserving information relating to human rights violations and abuses. He stated that he has reported on the Hazaras and other minorities but added that he had “not done enough” and that more should be done.
He recalled that in his first report he had noted that some ISKP attacks may amount to war crimes and crimes against humanity and that he had recommended that the United Nations Human Rights Council should establish a specific #inquiry into attacks on the Hazaras and other minorities. He observed that the Council had not yet done so."

Last week at the UN Human Rights Council, Accountability Watch Afghanistan, together with eight partner organizations, co-organized a side event to discuss the persecution of Hazaras and women and girls in Afghanistan.
The discussion highlighted the interconnected patterns of systematic discrimination, violence and persecution against the Hazaras and women and girls in Afghanistan, including targeted attacks, arbitrary detention, and restrictions on religious rights and freedoms of the Shia-Hazara community since the Taliban’s return to power in 2021. The event also explored the territorial and socioeconomic dimensions of marginalization and persecution of the Hazaras through cases of forced evictions and land dispossession as well as their long-term impacts and implications for protection, rights to housing, livelihood, safety and security, migration, identity, and belonging.
