This is correct. And Trump’s DOJ has been doing it over and over again. nytimes.com/2026/03/12/us/po…
Here is the bigger headlines. DOJ can collude with friendly states to re-write regulations it no longer likes without having to go through notice and comment. That's what happened here.

Reading the 1991 rule making that created 240-day auto-extensions for #H1B renewals and it is a good reminder that @Republicans engaged in rule making to AVOID gaps in work authorization, not cause them. #H1B

Under 8 C.F.R. § 208.6(b), “[t]he confidentiality of other records kept by DHS…that indicate that a specific alien has applied for refugee admission, asylum, withholding of removal…shall also be protected from disclosure…” #DisbarPercival
This illegal alien is @60Minutes poster child for what it claims are wrongful deportations. I pulled his file. His claimed reason for fearing Mali was that he is “gay,” just in case you’re wondering how bad the immigration fraud problem is.

Need a new EAD because USCIS spelled your name wrong or it was never delivered to you? 12.5 months (and you have to send the card with the typo in with the I-765).
One of the dumbest (did you know it has a B in it?) delays from @USCIS is any of the I-824 delays. Need to get USCIS to send your approved immigrant visa petition to DOS? That is currently being done in 14.5 months. All this takes is an email to DOS. Need a new copy of your approved petition because it was lost in the mail through no fault of your own? Also 14.5 months. All this takes is a reprint. Mind you, neither of these require them to actually make an adjudication, and USCIS charges $590 for this service... I had calls on both circumstances this week seeking to litigate the delays because they desperately need these administrative actions. Again, DUMB (with a B!) but this is an organizational failure and predates even @USCISJoe

Case in point. This isn't an individual with ongoing issues or a company with purported issues. Yet, USCIS is refusing to do anything. Moreover, the regulations require USCIS to issue a refund and continue to process the case. Unfortunately, under @USCISJoe, the premium teams seem to think they can withhold the money and issue a refund at the end. They often misrepresent the refund process. The regulations are clear on this, and people have to push back. Might be time for some action because I know there are many cases like this where USCIS is illegally withholding fees @BaniasLaw
.@USCISJoe has stolen hundreds of thousands of dollars in filing fees for cases he refuses to adjudicate, including premium processing cases. Does this count @WhiteHouse?

Every nation that loses control of its borders eventually pays the price. Thanks to @POTUS Trump, DHS is committed to enforcing America’s immigration laws and safeguarding our national sovereignty. Reject the third world. Export the third world.

I respectfully disagree with Judge Reyes here. I’ve seen plenty of woods and water fronts thanks to golf!

DOI deputy chief Greg Wischer, testifying about his knowledge of Trump's plans for the golf course, admits he's not a golfer. "Me neither," Reyes responds. "A good walk ruined."

Here is the thing I’ve learned being in Judge Reyes’ court. She isn’t summoning government officials just to swing her power around. In the hearing @BaniasLaw and I had with her, she asked DOJ for an answer. They couldn’t give it so she told them to get ICE counsel. They didn’t have an answer because the decision was made above them. So she said she’d keep going through the chain of command until someone could provide simple answers to basic questions. The issue with the current administration is that they are executing things at the top, and then get indignant about being asked about those (many times unlawful) decisions.
Replying to @MacFarlaneNews
There it is: Trump Admin objects to judge’s order that a top appointee of Interior Secretary Doug Burgum testify about the toppling of 100s of trees at East Potomac Park in DC Admin didn’t draw the line when it was civil servants being questioned

While the job posting is absurd and shows USCIS has no intent to follow its Congressional mandates, there is some humor in it. For example, an ISO job posting on USAJobs.gov shows the position "requires no college degree." While I do not personally think a college degree is the end-all be-all of anything, it is funny when we see some of the stuff USCIS sends on EB-1As, NIWs, and O-1s, and others. Individuals who are some of the top tier in the world (or close to it) are seeing pushback from a role that "requires no college degree."
I’m sure the people hired for these jobs will treat all cases with complete professionalism and in an unbiased manner.
