Maurene Comey was removed last year from her role as a criminal prosecutor in the Southern District of New York without legitimate cause. Judge Furman ruled that the firing ran afoul of restrictions put in place by Congress that carefully limit the manner in which assistant U.S. attorneys can be removed. “Defendants’ contention that recent Supreme Court decisions have fatally undermined that precedent is not one that this Court, as a lower court, may accept.
