Yesterday, the EPA requested an extension to its deadline to appeal the federal court’s ruling that the Agency must take regulatory action to address the neurological risks posed by adding fluoride chemicals to water. EPA’s request came the day after EPA’s announcement that it will be conducting an “expeditious review” of the current science on fluoride’s dangers. The Ninth Circuit quickly granted EPA’s request, and has given the Agency until May 12 to file its appeal. If EPA is serious about protecting Americans from unsafe drinking water, it will use this extra time to regroup and stand down on its appeal of the court’s order. Rather than appeal the order, the EPA should do what the court wisely instructed: begin rule-making proceedings to eliminate the unreasonable risk posed by fluoridation chemicals in our water.
