3. CoA also struck down Regulation 83(2) & Regulation 87(2)(c) of the Elections (General) Regulations, 2012 for making polling station & constituency results subject to IEBC confirmation or designating them as provisional. This informs our rejection of a National Tallying Centre.

2. In Maina Kiai case Section 39(2) & Section 39(3) were invalidated as they treated polling station & constituency presidential results as provisional & subject to alteration/confirmation by IEBC. Court ruled those results are final & unalterable by the IEBC at a national level.

1. I will answer on behalf of the Maraga-Led People's Coalition on Electoral Reforms @Reforms_Ke. Court of Appeal has in 2 seperate cases in 2017 & 2018 (Maina Kiai v IEBC & Katiba Institute v NA) held various Sub-Sections of S.39 UNCONSTITUTIONAL. Most were amendments in 2017.

Hon. Caroli Omondi as People's Coalition on Electoral Reforms @Reforms_Ke Co-Convener, presented common-sense amendments drafted by the @dkmaraga-led Coalition in public interest including a new Section 39 to enhance transparency of voter-turnout & results. Senate should REVISIT.
The National Assembly’s decision to reject amendments proposed by the Senate and Suba South MP Caroli Omondi to allow live-streaming of election results has inadvertently pushed the country back to a clause the court declared unconstitutional. Parliament on Friday fought off allegations that it banned the live-streaming of election results following the passage of the Elections (Amendment) Bill, 2024, during a stormy session on Thursday. Nobody shall stop livestreaming of elections results with our generation. That history is behind us. If IEBC does not stream live ,we shall stream live. Kenya must get a renaissance!

We called on the National Assembly to put the interests of Mwananchi first, they have not. The issue of livesteaming election results is about transparency, accountability & credibility of the IEBC. @NetoAgostinhoMP @dkmaraga @HonJBMuturi @CaroliOmondi

Livestream transmission of election results should not even be up for discussion! The IEBC must deliver a transparent election. How will they do that while hiding the results from Kenyans?
The National Assembly has approved the Elections Amendment Bill 2024, which could scrap mandatory livestreaming of polling station results, raising fresh concerns over transparency ahead of the 2027 General Election. #KTNPrime @TheJesseRogers

We are demanding that the IEBC livestreams official election results online, this is what electoral transparency means. The government cannot pupport to support transparency while seeking to scrap the live transmission of the election results from Kenyans! #Maraga27 #UGMParty #Kumekucha @dkmaraga @Reforms_Ke

TRAGIC: National Assembly has as it did in 2024 aborted its duty to cure the issues of the National Tallying Centre & results transmission by refusing to debate/consider/pass a new Section 39 as proposed by @Reforms_Ke led by @dkmaraga and presented by @CaroliOmondi. @UGMParty

The right to vote means little if citizens cannot confidently follow how their votes are counted and reported. MPs should strengthen electoral transparency, not weaken it. Kenya deserves an election process that leaves no room for unnecessary suspicion. #Democracy #KenyaElections

Fellow Kenyans, the Constitution is clear. The electoral system must be “accurate, verifiable, secure, accountable and transparent” No law is superior than our Katiba. I will work with the People’s Coalition for Electoral Reforms @Reforms_Ke to thwart any efforts to return us to the dark era of ECK or the post election violence of 2007/08.
