It was a surreal moment at Brian Cole Jr court hearing on Wednesday. I even had to ask @RobGouveiaEsq if my ears had deceived me. Prosecutors openly stated they expected interference - from both @CIA and @CapitolPolice - in discovery requests by the defense. I mean … we already knew who we were up against in this fight, but that was a shocking admission. I’ve told you for a solid year that the pipe bomb event was a “multi-agency conspiracy.” Can you count how many we’re up to thus far?
Federal prosecutors signal that the CIA and Capitol Police could intervene to quash defense subpoenas seeking critical phone evidence from an alternative January 6 pipe bomb suspect.

Kerkhoff's 2014 Ford Focus SE is somewhat of a mystery in itself. It was apparently sold as "salvaged" in June of 2020. But once again, when Cole's defense team requested information on this vehicle from the government, their response was, "DMV records for Ohio plate [XXXXXX] were requested and returned negative results..." Apparently, @FBI has no information about Kerkhoff's salvaged 2014 Ford or the 2020 Subaru she is captured on video driving on J5 and J6. Is that evidence that @CIA is successfully scrubbing her "history," or just more compounding and overt examples of the FBI's and @TheJusticeDept's intention to withhold vital evidence from the defense in the Brian Cole Jr. case? #FreeBrianColeJr

Why does @FBI have no information about the Subaru Kerkhoff was driving on J5 and J6? Lack of effort? Incompetence? Cover-up? They were initially obsessed with a Subaru as their own "VOI1." (Image below.) Considering that Kerkhoff is seen parking in a "permit-only" lot on the 6th, drove past many license plate readers, and was herself a "PERSON OF INTEREST" for many weeks, it seems unlikely the FBI would have no records of that car. EXCEPT... my team had the same problem when we first investigated Kerkhoff's vehicle ownership history, even before we published our infamous Nov. 8, 2025 story. We could only find two vehicle ownership records associated with Kerkhoff: a 2014 Ford Focus SE and a 2022 Subaru Outback Wilderness. Nothing on the 2020 Subaru Crosstrek. (Continued. ⬇️)

In the latest court filings, this image shows the government's responses (in italics) to Brian Cole Jr.'s defense request for very specific discovery related to the 2020 Subaru Crosstrek Ms. Kerkhoff is seen driving to and from work on both J5 and J6. Note the government prosecutor's response: "The FBI has no records for a 2020 Subaru." This is most interesting, considering that is exactly what Kerkhoff is driving on those two days. Given that @FBI already has a proven track record of hiding both video and phone records in the pipe bomb case, this adds another layer of suspicion. (Continued. ⬇️)

At the outset of @FBI's pipe bomb investigations, they had a very particular interest in collecting information on Subarus, as they seemed to have been their primary "Vehicle of Interest" (VOI). Interestingly, they didn't mention a 2017 Nissan Sentra, the car owned and driven by Brian Cole Jr. (Continued. ⬇️)

🚨EXCLUSIVE New Video🧵 - Today is the 1st Anniversary of our article published @theblaze naming a possible forensic match to the J6 pipe bomber. An event that set off a chain reaction that forever affected many people's lives. Rather than review the complexities of the last year, I'm going to keep it simple today. This video shows Ms. Shauni Kerkhoff arriving at @CapitolPolice HQ on the morning of January 6, 2021. (Continued in comments below. ⬇️)

No disrespect to Nicolas, Don’t fall for on narrative jersey swaps. They can do that every two years and keep you captivated with meaningless rhetoric. Assume enemy fire until actions actually materialize. This is the exact zero-cost placation I’d expect after a mid term faceplant.

Brian Cole Jr. Trial: Circumstantial Evidence Cannot Deny Someone Their Constitutional Right to Counsel of Their Choosing 1. The FBI began investigating a CIA officer. They performed a gait analysis on her that could not rule her out. They administered a polygraph that indicated deception regarding whether she planted the pipe bombs. The polygraph interviewer noted that her answers explaining why she failed seemed rehearsed. 2. The FBI ruled the CIA officer out based on a single piece of circumstantial evidence: a time-stamped video that merely contained the voice of the officer. That video, which was recorded on an iPhone 7, appears to have been transferred to an iPhone 12 and provided to the FBI with consent from the iPhone 12. Because the video cannot directly show the presence of the CIA officer, the video itself constitutes circumstantial evidence. 3. The defense seeks to present an alternate-perpetrator case based on the same evidence the FBI developed against the CIA officer. A voice heard on video, timestamped or not, cannot establish presence, leaving the FBI’s investigation incomplete. The defense is seeking the circumstantial evidence surrounding the video, much of which the FBI never obtained—such as acquiring video from the home where the officer is heard on the recording. 4. To avoid providing this material, the prosecution is seeking to remove Brian Cole Jr.’s constitutional right to an attorney of his choosing. Based on circumstantial evidence alone, they claim that no one could possibly believe the CIA officer is innocent; therefore, the lawyers are acting against Cole’s best interests. To establish this idea, they present a derivative file that merely contains a voice, which cannot, in itself, imply presence. Knowing that the video itself is wholly inadequate to establish innocence, they have introduced additional circumstantial evidence, such as a text from the officer saying they were “coming home!” that occurred 24 minutes before the officer actually drove off. 5. On one hand, the prosecution wants to use circumstantial evidence to bolster their chief piece of circumstantial evidence. On the other hand, they seek to deny the defense that same body of circumstantial evidence from which they are drawing. If that body of circumstantial evidence demonstrated the officer’s innocence, then why not provide it to the lawyers? The prosecution claims that Litson is acting against Cole’s interests so that they can bolster their civil defamation case. But if the circumstantial evidence shows that the officer is innocent, how would that bolster the civil case? The fact is that this body of evidence cannot act asymmetrically. It will either weaken both the civil and criminal cases, or strengthen both the civil and criminal cases. Apparently, the DOJ is not willing to let the evidence speak for itself—and that is likely because it cannot speak for itself.

SETH RICH UPDATE. Did the FBI just give the middle finger to the White House? In September in our FOIA lawsuit, we made the court aware of numerous records released by the White House, records that should have been produced six years ago by the FBI in response to our request for records about Seth Rich and the purported “hacking” of the Democratic National Committee. In a court filing today, the FBI pushed back against statements and records released by the White House Transparency Task Force, dismissing it as “generalized criticism” that “do[es] not address the FBI’s conduct” related to the Seth Rich case. Oh really? The FBI admits it never searched the OXFERD COMMA or MARCH TOLL files and says it "has no reason to" search them now. It says its Washington Field Office knew the paper file existed and "would have manually searched those files" IF agents thought responsive records were in them. Mind you, this is a FOIA case about who transferred the DNC emails to WikiLeaks, yet the FBI never searched the very file whose first document states the FBI's own conclusion about who did it. Under @Kash_Patel, the @FBI is still fighting tooth and nail to protect its years-long cover-up of records about Seth Rich, Wikileaks, and the DNC “hack,” never mind what the White House says or thinks about it. Interestingly, the FBI finally admitted to the court – six years after the lawsuit was filed – that it never searched for part of our 2020 request at all: the part asking for records on "any other person or persons" who transferred the DNC data. Too vague, it says. Yet the OXFERD COMMA memo names exactly who the FBI thought did it. Another interesting development: the FBI belatedly admits that for “prohibited access” files, a search of its Sentinel system only returns a placeholder. The actual file “must be located and requested” to see what’s in it. That’s significantly different from what the FBI told the court in 2025, when its testimony made it sound as if a Sentinel search would produce “prohibited access”. Bottom line: if a file is designated “prohibited access,” then its contents will NOT be found during a records search. So were the Seth Rich files designated “prohibited access”? The FBI still won’t give us a straight answer. Likewise, the FBI won’t give us a straight answer about records discovered in a secret room at FBI headquarters. In August 2025, after Deputy Director Bongino disclosed a hidden room of Russiagate records, the FBI swore it had "initiated a search" of that room and promised: "Upon completion of the search, the FBI will notify the Court and Plaintiff of the results." The court relied on that promise to deny our motion at the time. Fifteen months later, and despite its promise to the court, the FBI has reported nothing. You may recall that on July 6, I disclosed a conversation wherein a government attorney told me that “several hundred pages” related to Seth Rich were discovered in that secret room. I’ve since been told that I misunderstood what I was told. I don’t think I did, but consider me duly chastened: next time I won’t be reporting anything that the government tells me unless I have it in writing. This much I can say for certain: the FBI is still hiding gigabytes of data about Seth Rich and the DNC “hack,” because it is still refusing to produce records from his electronic devices despite multiple orders from the Court. The FBI's position, stripped of the lawyering: the White House's statements about these files don't matter, the declassified records don't matter, we never looked in the files, we won't tell you what was in the secret room, and we won’t tell you what was on his laptops. But trust us, Seth Rich died in a botched robbery that had nothing to do with Wikileaks or the DNC. Will President Trump ever fire Patel? I certainly hope so. The President’s appointees at DOJ and FBI have been a disaster. Contrast Pam Bondi, Todd Blanche, and Kash Patel with his appointees elsewhere: Marco Rubio, Scott Bessent, Pete Hegseth, RFK Jr, and Tulsi Gabbard, just to name a few. The difference is night and day. I’d argue that the Justice Department should have been the top priority from day one, yet it never got the talent or the attention that other departments and agencies did. And I hope it’s not too late to fix that. In fairness, I should note that the GOP Congress wasn’t any better. When my July 6 post went viral, Congressman @TimBurchett very publicly released a letter to Patel requesting release of the records (teapaw.org/timburchett/status/207…). A mutual friend gave me the Congressman’s email and cell phone, and I briefly exchanged information with the Congressman. Then he went completely silent. Why? Even Julian Assange has remained silent despite his release from custody, although I can’t blame Assange after what our government did to him. I’ve posted links to the government’s court filings below. I’m angry and I’m tired, but I’m cautiously optimistic that Chief U.S. District Judge Amos Mazzant III, the judge presiding over our FOIA case, has had enough of the FBI’s games. Or maybe new White House Chief of Staff @StephenM will light a fire under somebody. Either way, we will be responding to the FBI next week, and we will meticulously inform the court of every lie and equivocation. lawflog.com/wp-content/uploa… lawflog.com/wp-content/uploa… lawflog.com/wp-content/uploa…
I have called for @FBIDirectorKash to release all records related to the death of Seth Rich.

I tried to say it respectfully, but it must now be said forcefully. I want to win in 2028. And neither the Trump 2024 coalition base nor 75% of independents are going to vote for any candidate in 2028 who campaigns on war and rising prices over peace and prosperity.

🧵EXCLUSIVE: The Hemp Mogul, the Chief of Staff’s Daughter, and the Race to Save Synthetic THC America’s self-proclaimed largest synthetic-cannabinoid supplier is carrying two state consumer-protection settlements, a federal racketeering counterclaim, a bank lawsuit, and a bankruptcy in his corporate family. This summer he married the daughter of the White House Chief of Staff — just as the White House began pushing Congress to soften the hemp ban that its own National Drug Control Strategy demands.

Yes.. I have known about this for the last ~18 months and did not raise alarm over it as 1)they weren’t married when I learned of the engagement (but have been for maybe a year?) and I’m a not a private investigator that could really confirm the people involved. 2) I’m in the industry and can be accused of attacking the administration to benefit our business. I think the later point is debatable. We don’t test for cannabinoids but we do have revenues from cannabis testing labs for cannabis microbial testing which isn’t really relevant for purified synthetics as these undergo no regulated testing and… The synthesis process usually eliminates those live microbial risks but competes with plant grown extracted THC which may have mycotoxin or pesticide enrichment via extraction. We also do not provide products in pesticide or mycotoxin testing but some of the labs that do perform that work could be customers of ours for other flower or nutraceutical testing of different products. That nuance may be lost on people and still be viewed as a conflict. Similarly, we host a medical cannabis based conference every year where physicians generally condemn these gas station products as they are often laced with 7-0H or other more potent lab derived synthetic cannabinoids and there is rampant CofA fraud on the products. She is out of office now and those conflicts (on both sides) should be reviewed by independent parties. What I have done is perform studies that highlighted the general risk we found in hemp flower sold online as the reports of the actors involved was not something I could put a pipette to and hope others confirm or deny those connections. We did find lab derived delta8 sprayed on hemp and sold online with limited age gating. The sequencing of these strains produced an interesting map of relatedness amongst various online providers.

Susie Wiles son in law is one of the largest gas station synthetic Cannabinoid (THCP) peddling providers in the country. This is a bipartisan issue. No one wants untested synthetics cannabinoids that are 33X more potent than THC yet sold at gas stations with lower safety testing standards than highly regulated dispensaries. @TheDankInformer has the receipts. @joeroganhq @RandPaul
