ANDREW AND TRISTAN TATE DENIED BAIL: THEIR OWN EVIDENCE UNDERMINED THEIR APPLICATION A US federal judge has refused Andrew and Tristan Tate bail while they contest extradition to the UK. They will remain in federal custody. The Tates had to show they posed no flight risk, no danger to the community and that special circumstances justified releasing them. Judge Lauren Louis found that they failed on every part of that test. She described the brothers as “quintessential flight risks” with an “exceptional capacity to flee the jurisdiction”. Much of the difficulty came from the defence’s own evidence. The Tates argued that the seizure of their assets in Romania had left them without the means to flee. But a witness called on their behalf said they continued to support their families abroad and that Andrew had bought her luxury accessories even after the seizures. The court also considered their extensive international travel, strong ties abroad and lack of any demonstrated ties to Miami. Andrew emphatically denied ever controlling a particular social-media account that boasted of having the means to evade the law. A video showed him identifying that account as the best way for followers to contact him. The judge said this “directly impeached” his own evidence. Tristan’s explanation for what the Order describes as a fake Mexican passport also changed. Their written reply described it as a cardboard Halloween prop based on a James Bond novel. At the hearing, the story was different. Tristan said an assistant had printed it for him around 2021. It was undisputed that the CURP identification number shown on it had been issued by the Mexican Government. The judge found a “dearth of competent, credible evidence” of local ties, stability or an absence of incentive to flee. On danger to the community, the court relied on the nature of the alleged offences, including allegations of forcible rape and choking. A defence witness said Andrew had not abused her or their child and described both brothers as loving fathers. The judge found that this evidence did not answer the allegations concerning their treatment of other women. Their claim that they had complied impeccably with restrictions imposed in Romania was also undermined. The Tates admitted that the relevant contact with alleged victims or witnesses had occurred, but disputed that it amounted to witness tampering. The judge left that question to the Romanian courts. She found, however, that the contact was prohibited and had breached the restrictions imposed upon them. I should note that these were findings about the risks associated with release, not findings that the underlying criminal allegations are true. The defence also relied on a number of claimed “special circumstances”. The judge rejected them individually and together. She found that their challenge to probable cause was commonplace and premature, and that their reliance on the Romanian surrender orders asked the court to resolve a supposed dispute between Romania and the UK that neither country had even asserted. Their public profile did not assist them. The court was not persuaded that their visibility prevented them from fleeing, particularly when their own case was that their public statements about wealth and evading law enforcement could not be taken seriously. The judge described their evidence about conditions at the Miami detention centre as “thoroughly impeached”. Their own testimony undermined claims about almost complete confinement, lack of access to the commissary and substantial weight loss. The evidence showed that they had even gained some weight. They produced no medical evidence of deteriorating health. Their Romanian argument also failed. The declaration filed by their Romanian lawyer did not establish that detention made their participation in those proceedings impossible. On the evidence before her, the judge described the concern as “conjectural”. This was not a refusal based on a technicality or one narrow issue. The Tates failed to satisfy every part of the test for release, and evidence presented on their behalf undermined several of their own arguments The ruling does not decide whether they will be extradited or whether any criminal allegation is true. My clients are four British women bringing civil claims against Andrew Tate arising from allegations that he raped and assaulted them. Those claims are separate from the criminal and extradition proceedings. Tate denies their allegations. The Tates deny wrongdoing and are entitled to due process. The women whose allegations have waited years to be heard are entitled to it too.
