The Ethics and Anti-Corruption Commission (EACC) welcomes the sentencing of former Kiambu Governor Ferdinand Ndungβu Waititu Babayao, his wife and two other individuals and corporate entities following their conviction for money laundering.
The Milimani Anti-Corruption Court imposed fines of up to Kes36 million on the accused persons and companies, with default prison terms ranging from two to 13 years.
The sentences followed a High Court decision delivered on October 14, 2026, which reinstated money laundering charges against Waititu, his wife Susan Wangari Ndungβu, and Charles Chege Mbuthia and his wife Beth Wangechi Mburu who are directors of Testimony Enterprises Limited.
The court imposed the following penalties:
1.Ferdinand Ndungβu Waititu Babayao: A fine of Kes21 million or 13 yearsβ imprisonment in default.
2.Charles Chege Mbuthia: A fine of Kes28 million or 13 yearsβ imprisonment in default.
3.Beth Wangechi Mburu: A fine of Kes6 million or six yearsβ imprisonment in default.
4.Susan Wangari Ndungβu: A fine of Kes2 million or two yearsβ imprisonment in default.
5.Testimony Enterprises Limited: A fine of Kes36 million.
6.Saika Two Estate (A company owned by Waititu and his wife Susan): A fine of Kes24 million.
The case originated from investigations launched by the Commission in 2019 following allegations that the County Government of Kiambu had irregularly awarded Testimony Enterprises Limited a contract worth Kes588 million for the upgrading of gravel roads to bitumen standards in Thika, Limuru, Gatundu North, Juja and Ruiru sub-counties during the 2017/2018 financial year.
On February 12, 2025, Waititu and his co-accused were convicted of various offences, including conflict of interest, dealing with suspected property, abuse of office, fraudulent procurement practices and wilful failure to comply with procurement laws and regulations.
For these offences, the court imposed the following penalties:
1.Ferdinand Ndungβu Waititu Babayao: 12 yearsβ imprisonment or a fine of Kes52,749,000.
2.Susan Wangari Ndungβu: One yearβs imprisonment or a fine of Kes500,000.
3.Luka Mwangi Wahinya: Seven yearsβ imprisonment or a fine of Kesmillion.
4.Charles Chege Mbuthia: 11 yearsβ imprisonment or a fine of Kes297,048,110.
5.Beth Wangechi Mburu: Three yearsβ imprisonment or a fine of Kes1.4 million.
With the additional penalties imposed for money laundering, the cumulative fines and default custodial sentences for the four individuals are as follows, taking into account the concurrent running of custodial sentences as ordered by the High Court:
1.Ferdinand Ndungβu Waititu Babayao: Kes73,749,000 or 13 yearsβ imprisonment in default.
2.Susan Wangari Ndungβu: Kes2.5 million or two yearsβ imprisonment in default.
3.Charles Chege Mbuthia: Kes325,048,110 or 13 yearsβ imprisonment in default.
4.Beth Wangechi Mburu: Kes7.4 million or six yearsβ imprisonment in default.
The court further ordered Testimony Enterprises Limited and Saika Two Estate to pay their respective fines within 14 days, failure to which the amounts shall be recovered in accordance with Section 334 of the Criminal Procedure Code.
The case marks a significant milestone in Kenyaβs efforts to combat money laundering, strengthen accountability for proceeds of corruption and advance the countryβs commitment to addressing deficiencies identified by the Financial Action Task Force (FATF) as it works towards exiting the grey list.
Have looked at that tactic of strangulation? I may not know the location but it looks like a team work.
Truck drivers this the situation at Malaba so buy your lunch and drinks the traffic is becoming long.
You are at a club, request a ride from an Uber then your disrespectful behaviour advises you to pee on the Uber's seat.
This kind of behaviour can cost you pay for cleaning and drying the seats and the same time pay for the car per day return.
Before making yourself happy in this stunting manner then you should imagine what can happen in the next second but just view once.

Truck drivers recognises this 100L of fuel drainer that those fuel cartels use to con saying it's a 20L jerrican.
