Weighty ruling in defence of more than 450,000 teachers in this country. His Lordship Francis Kyambia finds the Application filed by TSC to lift/vary/discharge the conservatory orders issued on the 21st day of August, 2026 unmeritorious. On the 21st day of September, 2026 we made oral submissions in the High Court at Kiambu and based our arguments on the aspect of whether the TSC is crippled operation-wise if these orders remain in place. We argued that the Commission have a plethora of functions, discplining teachers is not the only function of the commission. We reiterated that discplinary is supposed to be approached on case to case basis. We emphasized in Court that the greater good the Court can do is to preseve Constitutionalism. One of the arguments made was the issue of Public interest. The greater public interest is the Court to preserve the centrality of the Subject matter of the case. The High Court emphatically agreed with our submissions today.
