Rajendra Arlekar’s action is unconstitutional and illegal. Does the Congress agree with this move? The public wants to know whether the Chief Minister shares the position taken by the Congress at the national level on such politically motivated actions. There are legal procedures to take action against a PSC member, but the Governor has not followed any of them. The state government has constituted a Special Investigation Team to investigate the allegations that arose in connection with the preparation of a rank list. The government itself informed the High Court that no evidence had been found so far. This is precisely why the court made certain critical observations. The Governor has no authority to recommend the dissolution of the PSC. The Governor is required to act in accordance with the recommendations of the state government. At a time when no allegations have been substantiated and no evidence has been produced before the court, has the state government asked the Governor to dissolve the PSC? It is no secret that, after targeting universities in the state, the Sangh Parivar is now targeting the PSC as well. Strong protests must be raised against Governor’s rule, which reduces democracy to a mere spectator. This anti-democratic move, which disregards the Constitution, will be challenged both politically and legally. The Governor has nothing before him other than certain complaints and media reports. These are not sufficient grounds for such an action. The Chief Minister must clarify whether the state government has handed over any crucial files or information relating to the PSC to the Governor. If it has, it can be considered yet another instance of the state government surrendering to the Sangh Parivar. The state government is prostrating itself before the Sangh Parivar. The entire state witnessed the farewell accorded by the state government to the Governor who implemented RSS policies in Kerala, as well as the Chief Minister’s show of affection towards him. Kerala has a Chief Minister who embraces Sangh Parivar leaders in this manner. We had earlier pointed out that several actions, including the appointment of university Vice-Chancellors, were part of a BJP-RSS deal. The Governor, who is supposed to act in accordance with the advice and recommendations of the state government, has been overriding the state government and proceeding unilaterally on all these matters. The same has happened in the case of the PSC. Kerala’s PSC functions in a manner that serves as a model for the rest of the country. Recruitment processes in Kerala are conducted swiftly. In the past ten years, the Kerala PSC has made more than one million appointments. The Governor is now attempting to undermine this very institution, with the UDF government supporting him. The Sangh Parivar, using the Governor as its instrument, is attempting to dismantle an entire constitutional institution by citing a few isolated incidents. Such incidents can be investigated, and strict action can be taken against those found guilty. However, destroying this constitutional institution is wholly unjustifiable.
