Thx @PhillipBantz for covering the extraordinary efforts of a few judges—and now the DOJ—to block a one-word addition aimed at making FRE 609 a shade less heinous. As always, your Coalition for Prior Conviction Impeachment Reform (reforming-pci.org) stands ready to fight.

At a conference on AI & legal profession. I'm sorry folks, but you are over-indexed on hallucinations. You aren't calibrated on the magnitude of the problem and it's possible that one reason is psychological. It's comforting to think that the robots will never be as accurate & diligent as we are. *I am NOT saying that AI doesn't hallucinate or never makes mistakes; indeed, I believe that it does.

I'm excited to share my newest piece that shows how prosecutors are increasingly using criminal conspiracy laws to criminalize social movements and protests, particularly in the age of ICE, building on Steffen Seitz's excellent work, as well as responding to Andrew Ingram

Vanderbilt Law Review (@VandLRev) will be publishing my latest, “Legality Canons.” It argues for a new way to understand many of the so-called substantive canons that the Supreme Court now employs. 🔗 👇🏻

Our 2024–2026 Special Report is out. We are in an exciting new era for the Georgetown Center for the Constitution. In the last two years, here's just some of what we've been up to: 175 legal scholars engaged 150 law clerks trained 80 judges convened 52 events hosted 5 meetings with U.S. Supreme Court Justices 4 new programs, from Research Fellows to Legal Philosophy & Constitutional Theory None of this happens without our small but mighty team, which punches well above its weight. It has been a privilege to build on the remarkable foundation laid by @RandyEBarnett as the Center's Founder, to work alongside @lsolum, our longtime collaborator, and to open a new chapter with a community this extraordinary. Take a look at our full report here: georgetowncenterforconstitut… @GUConstitution @GeorgetownLaw

New draft paper on SSRN: "Fact Avoidance," forthcoming in @HarvLRev Supreme Court Issue. This Essay identifies a recurring feature in SCOTUS case law, where the Court decides presidential power cases entirely on legal grounds without engaging at all with the facts /1

The one thing movies never get right about trials is the rules of evidence. And I don't just mean whether the objections are accurate or the evidence is admissible. Planning how you are going to get your evidence in, and keep their evidence out, is a big part of trial prep.
