But as a lawyer and as a Muslim, think about what the actual issue is as far as we Somali citizens are concerned. The issue is that we elected a man, gave him a four-year mandate, and he refused to vacate office after his term ended — despite saying many times that he would abide by the limits of his mandate. Now, the Somali Constitution, particularly the very first article — Article 1(2) — says: “It is prohibited for a person or a section of the public to claim the sovereignty of the Federal Republic of Somalia, or to use it for their personal interest.” Also taking into account that the Prophet ﷺ, when asked about the best form of jihad, said: “A word of truth spoken before a tyrannical ruler.” “كلمةُ حقٍّ عند سلطانٍ جائرٍ” Or when the Qur’an says: “وَٱلَّذِينَ لَا يَشْهَدُونَ ٱلزُّورَ” “And those who do not bear false witness.” So, legally, constitutionally, and Islamically speaking, whoever tells H.E. that his time has ended may well be on the right side of history and the law, even if that creates discomfort, embarrassment, or a lack of decorum.
