The electoral discourse in Zimbabwe has transcended from alleged judicial capture to the judicialization of politics. The Zim Courts have decided for the people on who their candidates are and have decided for the people of Mabvuku who their MP must be. Cry my beloved country

Between principle and practice: Participatory constitutionalism and judicial restraint in Fuza and Wakurawarehwa v Parliament of Zimbabwe. This commentary argues that the judgment reflects a dual posture - normatively robust on principles governing access to the court (locus standi) but conservative in application to resolve substantive issues. It contends that the court’s evidentiary framing narrows the practical enforceability of participatory rights and raises important implications for democratic accountability and civic space in Zimbabwe. @tsunga_arnold @bamujm @iamTSUNGA @AfricanJurists

Fuza and Wakurawarehwa v Parliament of Zimbabwe in Constitutional Court of Zimbabwe The central feature of the judgment, however, lies in its articulation of the evidentiary burden required to establish non-compliance with section 141(a) of the Constitution. The court held that applicants must demonstrate either a complete failure to facilitate public participation or that participation was so inadequate as to be merely tokenistic. Crucially, the court insisted on a holistic assessment of the legislative process. Isolated disruptions such as those alleged in Harare and Masvingo were deemed insufficient in the absence of evidence that the consultation process as a whole was defective. While this approach is doctrinally defensible, it has significant implications. By framing the central issue as one of evidentiary sufficiency, the court shifted the constitutional inquiry away from the qualitative content of participation and toward the procedural obligations of litigants. This shift may be understood as a form of judicial restraint. It allows the court to avoid invalidating legislation on the basis of isolated irregularities and preserves institutional comity between the judiciary and Parliament. However, it also raises concerns that the substantive meaning of participation may be underdeveloped in the Court’s jurisprudence. This under development of an important jurisprudential issue operates to undermine the people’s right to democratic participation. NEED FOR AWARENESS ON INTERSEX RIGHTS IN AFRICA There is a clear need for literacy and awareness on #Intersex people and their situation in Zimbabwe and the world We @tsungabamulaw are the ones who litigated on this important case in #Zimbabwe and are very proud of our achievement. We also appreciate the Government very much for committing to make informed and evidence-based law making proceed to deal with the gap in law that caused so much suffering to intersex people in Zimbabwe. We also appreciate the development partners especially the @UNDPZimbabwe for handholding everyone and giving technical assistance to help everyone understand the importance of legal protection of the rights of intersex people. My revered brother @MacBelts has sensetionalise a bit in his tweet below but I thought it is important to reassert the rights of people who are born with both sexes and emphatically state that they are as human as all of us and have protection needs that we all need to recognize and jealously guard. This case emphasizes the importance and value of strategic litigation in support of valiant advocacy for good causes. @bamujm @iamTSUNGA @mamukeleni @AfricanJurists @AGLawyers @LawyersofAfrica @AfricaDefenders @whrdinitiative @UN_SPExperts @FrontLineHRD @achpr_cadhp @AfrikParliament @sadcpf @civicspaceaf @TMF_Legacy

Different countries have different methods by which they select and appoint people into judicial office. Ultimately the characteristics that must inform judges notwithstanding how they are appointed is to depict independence and impartiality. When a judiciary is not independent and impartial, it cannot protect the rule of law and separation of powers. @tsunga_arnold @bamujm

Jurisprudence on sharing of matrimonial property #Zimbabwe @tsunga_arnold @bamujm
#dandarostreets High Court Justice Phillipa Phillips has awarded Caecilia Nyamutswa 100% of the Colne Valley home, 60% of the Vainona property and a 12-acre Shamva plot after finding that she paid the mortgages during her husband’s eight years of unemployment. Her husband, Cosmas Nyamutswa, will retain his Cessna aircraft, boats, fishing equipment, firearms and book royalties, along with 40% of the Vainona property. The court ruled that a 50-50 split was not appropriate, while recognising his indirect contribution as a house-husband. The court also dismissed his request for post-divorce medical aid and ruled that Caecilia is not responsible for university fees for their three adult children, officially bringing the marriage to an end. On the occasion of #LegalDay in France, we highlight those who defend human rights and promote access to justice around the world. In this video, @rose_hanzi , Executive Director of Zimbabwe Lawyers for Human Rights (@ZLHRLawyers), shares her mission to ensure that every person in Zimbabwe can enjoy equal rights and access to legal identity. 🤝 With the support of the Embassy of France in Zimbabwe, ZLHR is implementing the project “Promoting the Right to Citizenship and Identity” a nationwide initiative aimed at helping marginalized communities obtain birth certificates, national IDs, and passports, and advocating for fairer, more accessible registration systems Roselyn also draws a powerful link between this mission and the spirit of France’s Legal Day, reminding us that justice and equality know no borders.

CELEBRATING THE DAY OF THE AFRICAN CHILD Today, 16 June 2025, we join the rest of progressive global society in commemorating and celebrating the Day of the African Child. The Day of the African Child, commemorates and celebrates the courageous 1976 Soweto Uprising, where Black South African students protested the imposition of apartheid-era education policies and were met with brutal state violence. The day has evolved beyond its historical roots to become a continental and global call to action given the price that children continue to pay in an unfair and unjust world with rising systemic threats to children and impunity for perpetrators. In a time of global political realignments, Africa’s children are disproportionately affected by worsening inequalities, broken education systems, and the failure of governance to prioritize inclusive development. The scourge of illicit financial flows, enabled by global corporations and weak accountability, drains billions of dollars from African economies—robbing future generations of quality education, health care, and opportunities. The escalating climate crisis threatens food security, displaces communities, and deepens child vulnerability—despite Africa contributing the least to global emissions. Compounding this is the growing power of non-state actors, including economic actors that ignore Environmental, Social, and Governance (ESG) principles with impunity given the weaknesses in our judicial systems to appreciate their role in public interest litigation involving environmental degradation to focus on substance as opposed to forms of pleadings and court petitions. The extractive and exploitative practices of unscrupulous businesses, ranging from land grabs to labour and environmental abuses and violations—undermine child rights and erode social protections. In this context, the Day of the African Child is not only a moment of remembrance, but a strategic rallying point for justice: to demand that states and global actors center the rights, dignity, and futures of African children in policymaking, investment, and accountability frameworks. RETIRED CHIEF JUSTICES SCRAMBLE TO DEFEND JUSTICE IN EAST AFRICA In a strong gesture and symbol of defending the right to fair trial and justice retired Chief Justice Emeritus Maraga @dkmaraga of #Kenya went to observe the trial of Tanzania opposition leader @TunduALissu in Dar Strangely another Kenya former Chief Justice @WMutunga was denied entry into #Tanzania to observe the same trial. He was deported back to #Kenya in a highly embarrassing move. The interest by Kenya’s former Chief Justices in the entrenchment of justice and defending the right to fair trial in East Africa is unique and commendable. It is difficult to imagine that the interest at publicly defending justice by such senior identifiable leaders can be imagined in any other sub-region of Africa. Kenyans are lucky to have Chief Justices who genuinely personally believe in the right to fair trial. Hope they can appreciate this. Hope other retired Chief Justices from elsewhere can band together as a force in defence of justice in Africa working with institutions that have a framework for such work such as the @AfricanJurists and the @SeacjForum
The moment Kenya's former Chief Justice David Maraga met with Tanzanian opposition leader Tundu Lissu inside the Kisutu Resident Magistrate’s Court in Dar es Salaam on Monday, May 19, 2025. They exchanged a brief handshake and conversation before Maraga took his seat to follow the proceedings. Lissu is facing treason and incitement charges related to calls for election disruption ahead of Tanzania’s October 2025 polls.

The 6th Global Assembly of the Global Network on Electoral Justice – Medellin, Colombia Very proud that our managing Partner Arnold Tsunga @tsunga_arnold who is an Advisor on Elections and the Rule of Law for Africa Judges and Jurists Forum is participating at the 6th Plenary Meeting of the Global Network on Electoral Justice in Medellin, Colombia. Our passion for legal systems that have integrity and inspire public confidence that the judicial process is independent and impartial takes us to continue working with like minded entities across Africa and the Globe in the private and public sectors. The rule of law is very important as we experience geopolitical and geo-economic changes that require that all spheres of life, including economic investments must be responsive to environmental and social governance needs of communities in which we operate. The legal system and the rule of law must work to foster development and encourage those with capital to invest with confidence in Africa assured that there are fair and robust systems of adjudication of disputes and guarantees that investments will not face risks of forcible expropriation.
