Three weeks ago, @JaneAFlegal and I wrote a piece for the WSJ outlining the reforms that should be in a permitting deal and the urgency of passage this Congress, especially for Dems. The Bipartisan American Affordability and Jobs Act of 2026 meets the moment.

SCOOP: The Trump admin is easing its blockade on wind projects as it looks to motivate Democrats to support the Senate’s bipartisan permitting reform bill. A White House official told me DOD has advanced 2 projects in Maine & SD with more to come. Text subscribers got it 1st!

Is broad permitting reform a mixed bag? Of course it is. You'll make things that you want easier. But, you'll also make things you don't want easier. Nevertheless, unless you are in favor of doing nothing at all, such reform is probably still worth pursuing.

I have a lot of respect for @RoKhanna , but I want to make two points: First, why the line of attack he’s pushing here is wrong on the merits, and second, why it would be a big strategic blunder for Democrats to validate it. 🧵
It would be tone deaf if Congress makes it easier to build data centers right after an election with bipartisan rage against shoving them down the throats of local communities.

This is like saying reducing air pollution helps Trump breathe better, or that lowering gas prices helps data centers because they use gas. Staying “in the realm of facts” also means recognizing when something is a big stretch, to the point of being disingenuous.

Churchill could have shortened WW2 by years if he had just “done a deal” with Hitler. George Washington could have done a deal to end the American Revolution. Zelenskyy is in good company.

American clean energy is united. Permitting reform is essential to unleashing the affordable, abundant, clean power our communities need⚡

The push from industry, notably, comes as large environmental groups are questioning whether the benefits to clean energy from the permitting bill outweigh the trade-offs for boosting fossil fuels

At this point, engaging with this nonsense sort of just feels like this
BAAJA advocates themselves argue that permitting reform enables the construction of data centers. Here is Thomas Hochman, at the Foundation for American Innovation, for example.

Why is increasing American fossil fuel exports bad? If people are going to burn fossil fuels I’d rather it be American oil & gas rather than Russian, Iran, or Saudi oil and gas (or Indian or Australian coal).

Important context here via @BenKrauss5: the campaign to tar BAAJA as a handout to data centers is completely astroturfed, spawned by fringe groups who fear that Democrats might end their business model - litigating against energy projects - to build more clean energy.
Replying to @SearchlightInst
"The truth is that BAAJA isn’t just critical to decarbonizing our economy and meeting future energy demand; it’s also the only realistic legislation we have that will hold data centers accountable and protect ratepayers from future price increases." wordsinsearchlight.org/p/con…

It would not even do that? Bill very clearly makes data centers pay double for transmission infra. It’s like the big main explicit section, titled “ratepayer protection” that says data centers must pay double?

Ensuring the process of building energy infrastructure remains haphazard and sclerotic to own Big Tech.
First instance of a Hill Democrat openly criticizing BAAJA’s data center provisions. Some progressives quietly believe the bill is a handout to Big Tech, despite the bill’s ratepayer protection language.

The idea that BAAJA helps data centers is bullshit. To the contrary, it contains aggressive accountability measures *against* data centers. Judge the merits of the data center attack for yourself—this screenshot is the entire basis. But I want to make a larger point here. The effort to manufacture this attack out of thin air is being led by left-wing groups, against Democrats. With the midterms a few weeks away, this is how they choose to spend their time and energy. This is a perfect example of how the left-wing advocacy community has curdled and turned in on itself. And this is all over a bill negotiated by fierce climate champions @SenWhitehouse and @SenatorHeinrich—a bill which even critics acknowledge will reduce carbon emissions and supercharge the green energy buildout. With Democrats poised to take power in few weeks, candidates and lawmakers should take note: these folks are not your allies.
In an Orwellian turn, critics of BAAJA are trying to misrepresent the bill by saying its strong accountability measures are somehow "pro-data center." @BenKrauss5 on why it makes zero sense. wordsinsearchlight.org/p/con…
